HomeMy WebLinkAboutPC RES 2802 6 8 9 10 11 13 14 15 16 17 18 I9 ~0 21 25 27 28 RESOLUTION NO. 2802 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA RECERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85- 2), AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA, AS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR A USE DETERMINATION REGARDING EMPLOYEE TRAINING CENTERS WITH THE ADOPTION OF ADDENDUM 90-02 TO SAID EIR AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: -. A· That an application was filed on behalf of The Good Guys! (Use Determination 90-02), requesting that limited employee training centers be added to the list of conditionally permitted uses in the Mixed Use land use category of the East Tustin Specific Plan (ETSP). Bo That an Initial Study was prepared during the review process which determined that no significant environmental impacts will occur as a result of Use Determination 90-02 and that an addendum to Environmental Impact Report (EIR) 85-2, a Program EIR, was required for this project. Ce That the City provided public notice of its initial study and its intention to prepare an Addendum for the project. De That Addendum 90-02 to EIR 85-2 was prepared by the City of Tustin in compliance wiht the California Environmental Quality Act (CEQA) and CEQA Guidelines, and is attached hereto as Exhibit A. E· That Addendum 90-02, prepared for this project, addresses only minor technical changes or additions and none of the conditions described in Section 15162 of the CEQA Guidelines have occurred. 5 6 7 8 9 10 11 13 14 15 16 17 18 I9 20 ~2 ~3 ~4 25 ~6 28 Resolution No. 2802 Page 2 Fe The East Tustin Specific Plan Final Environmental Impact Report previously certified on March 17, 1986, and subsequently amended by adopted supplements and addenda, was considered prior to approval of this project. The Planning Commission hereby finds: this project is within the scope of the East Tustin Specific Plan previously approved and subsequently amended; the effects of the project were examined in the Program EIR and an addendum to Final EIR 85-2 addressing parking, contained in Exhibit A, attached hereto and incorporated herein by reference. All feasible mitigation measures and alternatives developed in the Program EIR and said addendum are incorporated into this project. The Final EIR, with addenda, is therefore determined to be adequate to serve as a Program EIR for this project and satisfies all requirements of CEQA. Applicable mitigation measures identified in the Final EIR and Addendum 90-02 have been incorporated into the project. II. The Planning Commission of the City of Tustin does hereby recertify that Final EIR 85-2, with Addendum 90-02, has been completed in compliance with the California Environmental Quality Act. K~.~h-L~EN ~I~ATRI CK Recording Secretary E_X~__IBIT A DRAFT ADDENDUM TO FINAL EIR 85-2 FOR EAST TUSTIN SPECIFIC PLAN (STATE CLEARINGHOUSE %85052217) RESOLUTION NO. 2802 July 23, 1990 INTRODUCTION On March 17, 1986, the Tustin City Council certified as complete the East Tustin Specific Plan Final Environmental Impact Report 85- ~ (EIR 85-2). EIR 85-2 addressed the potential environmental impacts associated with the development of a ± 1,740-acre master planned community proposed in the City of Tustin. EIR 85-2 was prepared as a program EIR in accordance with Section 15168 of the CEQA Guidelines. Pursuant to Section 15188(c) of the CEQA Guidelines, all "subsequent activities in the program must be examined in light of the program EIR to determine whether an additional environmental document must be prepared." In conformance with the provisions of CEQA, an addendum to EIR 85-2 covering Assessment District 85-1 was certified by the Tustin City Council on July 21, 1986. Subsequently, a Supplemental EIR to EIR 85-2, covering the East Tustin Specific Plan Development Agreement was certified by the Tustin City Council on October 22, 1986. Another addendum to EIR 85-2 for high mast lighting in the Tustin Market Place was certified by the City Council on February 1, 1988. In conformance with Section 15164 of the CEQA Guidelines, this document is an addendum to EIR 85-2. An addendum can be prepared when changes are made to a proposed project and such changes do not create any new significant impacts, substantially worsen any significant impacts, or substantially lessen any significant impacts already addressed in the EIR prepared for the project. This is the case with the addition of an employee training center to the list of permitted uses in the Mixed Use land use category for the East Tustin Specific Plan. Per Section 15164 of the CEQA Guidelines, this addendum will be attached to the certified final EIR 85-2 for consideration by the decision-making body in its review of proposed development on the Mixed Use site in the East Tustin Specific Plan (the "Tustin Market Place"). PROJECT DESCRIPTION The applicant, The Good Guys!, has requested approval of a use determination to allow employee training centers as a conditionally permitted use in the Mixed Use land use category of the ETSP as well as CUP 90-17 to establish a 2,961 square foot employee training center to support their 17,736 square foot retail store, located in the Mixed Use land use category. The justifications for this proposal are summarized as follows: i · Employee training centers would be ancillary to or supportive of primary, permitted uses, and would not be Exhibit A Resolution No. 2802 Page 2 · · · permitted as a primary use in and of themselves. Employee training centers would be non-profit in nature and would be open only to employees of the operating company. Parking requirements for employee training centers will be based on the number of "students", instructors, and other full-time personnel at the center, and will not allow the number of required spaces for a training center to exceed that number required for the same square footage if it were used for the primary use (such as retail space). As an ancillary or supportive use to a primary, permitted use, employee training centers will be similar to an office use, consequently, application of the Tustin Sign Code for office tenants is appropriate. This will allow up to a six (6) square foot sign for such uses. IMPACTS As an ancillary or supportive activity to a primary permitted use, the environmental impacts resulting from employee training centers are less than or equal to other permitted or conditionally permitted uses in the Mixed Use land use category of the East Tustin Specific Plan. Limiting students, instructors and other personnel to a number where required parking matches or is below that which would be required if the subject floor area were used for a primary use, insures that parking shortages will not occur. Additionally, such centers would serve employees of a use located in the Mixed Use land use category and would not be open to the public. Furthermore, requiring a CUP for such uses grants the City greater discretionary authority to ensure compatibility and minimize impacts. ALTERNATIVES No Project - Under this alternative, a permitted or conditionally permitted use in the Mixed Use land use category would not be permitted to operate a training facility for its employees separately from their primary activity or place of business. No CUP - Under this alternative, employee training centers would Exhibit A Resolution No. 2802 Page 3 not be subject to a CUP, removing a significant amount of discretionary authority. Such uses would still be ancillary or supportive in nature. MITIGATION MEASURES i · Employee training centers shall be ancillary to or supportive of a primary use that is listed as permitted or conditionally permitted in the Mixed Use land use category of the ETSP and shall be located adjacent to said primary use. · Employee training centers shall serve only the employees of the operator. · Parking requirements for employee training centers shall be based on 1 space per every 2 students, 1 space per every 2 instructors and 1 space per every full-time staff (non-instructor). Under no circumstances shall the total number of required parking spaces for an employee training center exceed that number which would be required for the same square footage if it were used for the primary use or activity. · The hours of operation of employee training centers shall be the same as or less than those of the primary use.
