HomeMy WebLinkAboutPC RES 2785 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2785 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, AMENDING CONDITION X OF CONDITIONAL USE PERMIT 69-286, AUTHORIZING AN AMOUNT OF PARKING IN ACCORDANCE WITH CURRENT CITY CODE REQUIREMENTS, FOR THE SHOPPING CENTER LOCATED AT 14551 RED HILL AVENUE The Planning Commission does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ao That a proper application (Amendment to Conditional Use Permit 69-286) has been filed by C.C. Humphries to modify Condition X of Planning Commission Resolution No. 1051 to authorize an amount of parking in accordance with current City Code requirement for the shopping center located at 14551 Red Hill Avenue.'' Be That a public hearing was duly called, noticed and held on said application on June 11, 1990. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: · The proposed modification to the condition would still provide an amount of parking as required by the current City Code thereby meeting the intent of the original condition. D· That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted as evidenced in the above findings. Ee This project has been determined to be categorically exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. II. The Planning Commission hereby approves modification to Condition X of Planning Commission Resolution 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2785 Page 2 1051 to read, "x. Ail parking for the center shall be in accordance with the minimum amount required by the City's Municipal Code" subject to the conditions contained in Exhibit A attached hereto. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 11th day of June, 1990. Chairman Recording Secretary E_X~__IBIT A AMENDMENT TO CONDITIONAL USE PERMIT 69-286 CONDITIONS OF APPROVAL RESOLUTION NO. 2?85 (1) (1) (1) GENERAL 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped June 11, 1990 on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. 1.2 Use Permit approval shall become null and void unless implemented within twelve months of the date on this Exhibit. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department within thirty (30) days prior to expiration. 1.3 The property owner shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any permits and/or commencement of restriping. RESTRIPING PLAN *** 2.1 The parking lot shall be restriped in accordance with the approved restriping plan within 30 days from the date of this exhibit and prior to installation of the recycling facility in accordance with Planning Commission Resolution No. 2769. *** 2.2 The property owner shall deposit with the City within 10 days from the date of this exhibit a cash bond of $7,500 to ensure completion of said improvements.
