HomeMy WebLinkAboutPC RES 2784 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2784 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 90-13, AUTHORIZING CONSTRUCTION OF A PARKING LOT, PICNIC GROUNDS AND PLAY AREA FOR COLUMBUS TUSTIN PARK The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A· That a proper application (Conditional Use Permit 90-13) has been filed by the Community Services Department of the City of Tustin, to allow construction of a parking lot, picnic grounds and play area for Columbus Tustin park located at 14652 Prospect Avenue. B· That a public hearing was duly called, noticed and held on said application on June 11, 1990. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: i · The use applied for is in conformance with the Tustin General Plan as the General Plan specifically list parks as a land use consistent with the Public and Institutional District. · The subject property is located in the Public and Institutional District and the use applied for specifically listed as conditionally permitted uses in said district. · The proposed use will not negatively effect surrounding property owners, in that the improvements are for the use and pleasure of the surrounding properties. 1 2 3 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23: 25 26 27 28' Resolution No. 2784 Page 2 D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. Ee The project is covered by a previous EIR (88-2) for the Second Amendment of the Town Center Redevelopment Plan. II. The Planning Commission hereby approves Conditional Use Permit 90-13 to allow construction of a parking lot, picnic grounds and play area for Columbus Tustin park located at 14652 Prospect Avenue. Secretary DONALD LE JEUNE Chairman E~IBIT A CONDITIONAL USE PERMIT 90-13 CONDITIONS OF APPROVAL RESOLUTION NO. 2?84 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped June 11, 1990 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this Exhibit shall be complied with prior to the issuance of any permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Use Permit approval shall become null and void unless all necessary permits are issued within one year of approval of said application. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department thirty (30) days prior to expiration. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. PLAN SUBMITTAL 2.1 At building plan check submittal: (3) A. Plans and calculations, to satisfy the requirements of the Uniform Building Codes and State Handicap Codes shall be complied with as approved by the Building Official. (2) B. (3) Final grading and specifications consistent with the site plan and landscaping plans and prepared by a registered civil engineer for approval of the Community Development Department. Information, plans and/or specifications to ensure satisfaction of all Public Works Department requirements including but not limited to: 1) 2) Enhanced paving will not be permitted within the street right-of-way at the two drives. A separate 24" x 36" street improvement plan will be required for all required construction within the public right-of-way, which should include but not be limited to the following: am Curb and gutter Sidewalk Drive aprons Street trees Street lights 3) 4) 5) The City will need an easement from the school district for the storm drain. The drive aisle from Beneta Way will need to be widened to 30 feet with a 30 foot curb radius. The 30 foot width shall taper down to 26 feet at the second parking aisle. The drive aisle width and radius type drive apron at Prospect Avenue will need to be revised to create a ± 308 square foot island to separate ingress from egress. The ingress drive shall maintain a 16 foot width while the egress shall maintain a 14 foot width. Additionally, a 40 foot curb radius for both shall be utilized. Information to ensure compliance with all requirements of the Orange County Fire Chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department, and City of Tustin Public Works Department and compliance with all requirements pertaining to construction as follows: Exhibit A Resolution No. 2784 June 11, 1990 Page 3 1) 2) 3) Prior to the issuance of any building permits for combustible construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants and access roads shall be in place and operational to meet requirements and fire-flow prior to commencing combustible materials. Prior to the issuance of any building permits, all underground piping for automatic fire extinguishing system shall be approved by the Fire Chief. These details shall include width, clear height, and means of emergency vehicle over-ride. All drives 28 feet or less in width shall be posted as "No Parking/Fire Lane". SITE CONDITIONS (1) 3.1 Note on final plans that a six foot high chain linked fence shall be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1) 3.2 Ail parking areas shall comply with the City of Tustin Parking Guidelines. LANDSCAPING, GROUNDS AND NARDSCAPE ELEMENTS (7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant materials in their actual location. The plan and table must list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Exhibit A Resolution No. 2784 June 11, 1990 Page 4 Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 4.2 The submitted landscaping plans at plan check must reflect the following requirements: ao Provide a minimum of one 15 gallon size tree for every 30 feet of property line on the property perimeter and five 5 gallons shrubs. Be Provide one 15 gallon tree for each 5 parking spaces within an open parking area. Co Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 8 feet on center when intended as screen planning. Do Ground cover shall be planted between 8 to 12 inches on center. Eo When 1 gallon plant sizes are used the spacing may vary according to materials used. F® Ail plant materials shall be installed in a healthy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condition, this will include but not be limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. Go Buffer driveway and parking areas from Beneta and Prospect with a 30" high landscaping berm. Ho Major points of entry to the project, shall receive specimen trees to create an identification theme. (1) 4.3 Provide details, colors, and materials for all exterior (4) walkways, stairs and walls. Design interior walkways to create a reinforced pedestrian corridor with accessory landscaping treatment. Exhibit A Resolution No. 2784 June 11, 1990 Page 5 (1) 4.4 Entryways to the project site should be focal points. In addition to larger tree treatments these areas should be provided with a variety of color and treatment of landscaping as well as an incorporation of special decorative pavement treatment. (1) 4.5 Indicate lighting scheme for project, note locations of (4) all exterior lights and types of fixtures. No lights shall be permitted which may create any glare or have a negative impact on the residential properties. The location and types of lighting shall be subject to the approval of the Director of Community Development. NOISE (1) 5.~ All construction operations including engine warm up shall be subject to the provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday or other times that the Building Official determines will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work.
