RESOLUTION NO. 2779
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING VARIANCE 90-03, TO
ALLOW A MONUMENT SIGN ON A 100-FOOT LOT WITH LESS
THAN THE REQUIRED 150-FOOT LOT WIDTH AND ALLOW THE
SIGN TO ENCROACH 10 FEET INTO THE REQUIRED 15-FOOT
BUILDING LINE SETBACK AND SUBJECT TO CONDITIONS AT
17561 E. SEVENTEENTH STREET.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application Variance 90-01 has been
filed on behalf of Craig Batley (RE/MAX Realty) to
allow a monument sign to encroach 10 feet into the
required 15-foot building line setback and on a 100-
foot lot with less than the required 150-foot lot
width at 17420 E. Seventeenth Street.
Be
That a public hearing was duly called, noticed and
held for said application on June 11, 1990.

That the Planning Commission has reviewed the
request to allow a monument sign to encroach 10 feet
into the required 15-foot building line setback and
on a 100-foot lot with less than the required 150-
foot lot width and can be supported by the following
findings:

There are unusual or exceptional circumstances
applicable to the size, shape, topography,
location or intended use of the subject
property which do not apply to other properties
in the same zoning district. Many commercial
properties in the area are larger than the site
and the applicant's one-story building is
located between two-story structures.
Visibility of the site may be impacted.
·
Granting of the Variance will not convey a
special privilege to the property owner which
is not enjoyed by other property owners in the
vicinity. Other businesses along Seventeenth
Street have been allowed monument signs within
the setback area.
·
The granting of the Variance will not be
detrimental to adjacent and surrounding
properties. The proposed sign is not in an
area of future road widening.

The granting of the Variance will not be
contrary to the goals and policies of the
General Plan.
II. Th~ Planning Commission hereby approves Variance 90-03
to allow a monument sign to encroach 10 feet into the
required 15-foot building line setback on a 100-foot lot
with less than the required 150-foot lot width, subject
to the conditions contained in Exhibit A and attached
hereto.
PASSED AND ADOPTED at a regular Planning Commission meeting
on the 11th day of June, 1990.

CONDITIONS OF APPROVAL
VARIANCE 90-3

*** 1.1 The design of the sign shall be modified so that the sign
(1) box is mounted directly on a planter or pedestal base,
to meet the zoning code definition of a monument sign.
In all other aspects, the proposed project shall
substantially conform to submitted plans date stamped
June 11, 1990 on file with the Community Development
Department as herein modified or as modified by the
Director of Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Variance approval shall become null and void unless sign
permits and all construction is completed within twelve
(12) months of the date of this exhibit.
(1) 1.4 Approval of Variance 90-03 is contingent upon the
applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.

PLAN SUBMITTAL
(1) 2.1 At building plan check and prior to issuance of sign
(4) permits, the following shall be submitted:

The applicant shall provide two copies of plans
including site plan, fully dimensioned and detailed
elevations, attachment methods and electrical
details for approval of the Building Official. All
electrical components shall be U.L. listed.
FUTURE REMOVAL/RELOCATION
*** 3.1 The applicant/property owner shall assume all costs of
removing or relocating the monument sign on Seventeenth
Street at such time that the City of Tustin deems
necessary to widen Seventeenth Street should it be
required for the public health and safety.
