HomeMy WebLinkAboutPC RES 2778 1 6 ? $ 9 10 11 12 14 15 16 17 18 19 20 21 22 23 2~ 25 26 RESOLUTION NO. 2778 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, AFFIRMING STAFF'S DENIAL OF DESIGN REVIEW 90-17 FOR THE REPLACEMENT OF AN APPROVED TURQUOISE COLORED AWNING WITH A PINK COLORED AWNING The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· That a proper application, Design Review 90- 17, was filed by Fat Freddies Restaurant, requesting approval of the replacement of an approved turquoise colored awning with a pink colored awning. Be That the Community Development Department's denial dated May 7, 1990 of the project was appealed to the Planning Commission by the applicant. C® That the project is categorically exempt from the requirements of the California Environmental Quality Act pursuant to Section 15301 (Class 1). De Pursuant to Section 9272 of the Tustin Municipal Code, findings must be made that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of building 2. Setbacks and site planning 3. Exterior materials and colors. 4. Type and pitch of roofs. · Size and spacing of windows, doors and other openings. · Towers, chimneys, roof structures, flagpoles, radio and television antennae. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2778 Page 2 · Landscaping, parking area design and traffic circulation. · Location, height and standards of exterior illumination including tennis court lighting. · Location and appearance of equipment located outside of an enclosed structure. 10. Physical relationship of proposed structures to existing structures in the neighborhood. 11. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 12. Development Guidelines and criteria as adopted by the City Council. II. The Planning Commission hereby affirms the staff denial of Design Review 90-17, a request for the authorization of a pink colored awning to replace a previously existing turquoise colored awning for an existing restaurant, as the following finding cannot be made pursuant to City Code Section 9272: · Exterior Materials and Colors - The proposed pink color is not compatible with the colors of the remaining building elevations, or buildings in the surrounding area. The proposed isolated use of such a bright color on a single architectural element of the building appears visually obtrusive instead of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19, 20 21 22 23 24 25 26 27 28 Resolution No. 2778 Page 3 complimentary to the remainder of the building as previously approved.
