HomeMy WebLinkAboutPC RES 2773 1 3 4 5 7 8 9 10 11 12 13 14 15 16 17 18 i9 ~0 22 ~4 25 26 RESOLUTION NO. 2773 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 90-10 AUTHORIZING A 50 FOOT TALL, 2.5 WIDE HIGH FREQUENCY RADIO RECEPTION TOWER WITH THREE ATTACHED ONE FOOT DIAMETER MICROWAVE DISHES AND SIX ANTENNAE AT 137 SOUTH PROSPECT. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That a proper application Conditional Use Permits 90-10) has been filed by Joseph Casasanta representing Continental Cablevision, requesting a 50 foot tall, 2.5 foot wide, high frequency radio reception tower with three attached one foot diameter microwave dishes and six antennae at 137 South Prospect. Be That a public hearing was duly called, noticed and held on said application on May 14, 1990 and continued to June 11, 1990. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use injurious nor detrimental to property and improvements on the neighborhood or the general welfare of the City evidenced by the following findings: · The use applied for is a conditionally permitted use within the Tustin Zoning Code. · The use applied for is consistent with the Land Use Designation of the City's General Plan which established the area as Commercial. · As conditioned, the proposal will not pose a threat to surrounding uses in that the tower will be painted skyblue to reduce its visual impact, and will be partially obscured from First Street. Additionally, the tower will correct visual interference experiences by the City's cable viewers. · A Negative Declaration has been prepared in accordance with the provisions of the California Environmental Quality Act. 8 9 10 11 12 13 14 15 16 17 18 i9 ~0 22 23 ~5 28 Resolution No. 2773 Page 2 II. The Planning Commission hereby approves Conditional Use Permit 90-10, authorizing a 50 foot tall, 2.5 foot wide, high frequency radio reception tower with three attached one foot diameter microwave dishes and six antennae at 137 South Prospect, subject to conditions contained in Exhibit A, attached hereto. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 11th day of June, 1990. Secretary EXHIBIT A CONDITIONAL USE PERMITS 90-10 CONDITIONS OF APPROVAL RESOLUTION NO. 2??3 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped June 11, 1990 on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, all conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Use Permit approval shall become null and void unless all necessary building permits are issued within twelve months of the date on this Exhibit. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 The applicants and property owners shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. BUILDING/SITE (1) 2.1 The tower, microwave dishes and antennae shall be painted *** "skyblue". The final color selection shall be subject to final review and approval of the Director of the Community Development Department prior to issuance of permits. Prospect shall be incorporated on to the tower. All antennae structures shall be removed from the roof of the existing building. *** 2.3 Ail utilities excluding serving the site and subject tower shall be undergrounded in accordance with City Code Section 8402(a) and installed in accordance with applicable Uniform Building and Electrical Code requirements. *** 2.4 A warning beacon light shall be added to the top of tower as a caution for aircraft approaching John Wayne Airport. PLAN SUBMITTAL (1) 3.1 At building plan check three sets of construction level plans shall be submitted as follows: A® Construction plans, structural calculations, and Title 24 energy calculations and requirements of the Uniform Building Codes and Energy Requirements shall be complied with as approved by the Building Official. Be Information to ensure compliance with all requirements of the Orange County Fire Chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department, City of Tustin Public Works Department and compliance with all requirements pertaining to construction. Miscellaneous *** 4.1 Any asphalt pavement damaged by construction activities shall be repaired and resurfaced as necessary for City standards (.3 feet asphalt concrete over .5 feet aggregate base). (1) 4.2 Ail construction activities shall be subject to provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. to 6:00 p.m., Monday through Friday or other hours and times the Building Official determines is in substantial Exhibit A Resolution No. 2773 June 11, 1990 Page 3 conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time a permit for the work is granted or during program on the work. FEES (6) 6.1 Prior to the issuance of any building permits, payment shall be made of all required fees including all applicable plan check and building permit fees to the Community Development Department.
