RESOLUTION NO. 2771
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, DENYING VARIANCE 90-08, A REQUEST TO
ALLOW THE GARAGES OF THREE DWELLING UNITS TO
ENCROACH A MAXIMUM OF EIGHT FEET INTO THE REQUIRED
20-FOOT FRONT YARD SETBACK.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Variance No. 90-08, was
filed on behalf of Standard Pacific L.P. to allow
the attached garages of three dwelling units to
encroach a maximum of eight feet into the required
20-foot front yard setback.

That a public hearing was duly called, noticed and
held on said application on May 29, 1990. .

That there are no unusual or exceptional
circumstances applicable to the property, relative
to size, shape, topography, location or
surroundings, that justify the Variance. The site
is level, regularly shaped, consistent with other
adjacent properties and consistent with the required
development standards of the East Tustin Specific
Plan.
Do
That the granting of the Variance would constitute
a grant of special privilege inconsistent with
development standards applicable to other properties
in the vicinity and district in which the subject
property is situated. No variances to allow yard
encroachments have been previously granted in East
Tustin.
That the granting of the Variance would be contrary
to the intent of the East Tustin Specific Plan and
have a detrimental impact on adjacent and
surrounding properties.

That the Variance request is not consistent with the
City General Plan. Varying development standards
of the East Tustin Specific Plan undermines the
integrity of the General Plan.

II. The Planning Commission denies Variance 90-08 as applied
for, to allow the attached garages of three dwelling
units to encroach a maximum of eight feet into the
required 20-foot front yard setback.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 29th day of May, 1990.
