RESOLUTION NO. 2768
A RESOLUTION.OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
AMENDMENT NO. 2 TO CONDITIONAL USE PERMIT 87-
7 AUTHORIZING 2,100 SQUARE FEET OF BASEMENT TO
BE CONVERTED INTO A LIBRARY AND COMPUTER
LEARNING AREA, AND APPROVING AMENDMENT NO. 2
TO CONDITIONAL USE PERMIT 79-20 BY PERMITTING
ENCLOSURE OF AN EXISTING 2,025 SQUARE FOOT
SHADE STRUCTURE IN ORDER TO CREATE THREE PRE-
SCHOOL CLASSROOMS.
The Planning Commission of the City of Tustin does
hereby resolve as follows:

The Planning Commission finds and determines as
follows:

That a proper application (Amendments No. 2 to
Conditional Use permits 87-7 and 79-20) ..has
been filed by Rollo Pickford representing the
Red Hill Lutheran Church, requesting 2,100
square feet of basement to be converted into
a library and computer learning area and
enclosure of an existing 2,025 square foot
shade structure in order to create three pre-
school classrooms on property located at 13200
Red Hill Avenue. The subject property is
further described as Assessors Parcel No. 103-
472-14.

That a public hearing was duly called, noticed
and held on said application on April 30, 1990

That establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfort, or
general welfare of the persons residing or
working in the neighborhood of such proposed
use injurious or detrimental to property and
improvements on the neighborhood or the
general welfare of the City evidenced by the
following findings:

The use applied for has been established
as conditionally permitted use within the
Public and Institutional (P&I) district.
EXHIBIT A
AMENDMENT NO. 2 TO CONDITIONAL USE PERMITS 87-7 AND 79-20
CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped April 30,
1990 on file with the Community Development Department,
except as herein modified, or as modified by the Director
of Community Development Department in accordance with
this Exhibit.
(1) 1.2 Unless otherwise specified, all conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Use Permit approval shall become null and void unless all
necessary building permits are issued within twelve
months of the date on this Exhibit. Time extensions may
be granted by the Planning Commission if a written
request is received by the Community Development
Department within thirty (30) days prior to expiration.
(1) 1.4 The applicants and property owners shall sign and return
an Agreement to Conditions Imposed form prior to the
issuance of any building permits and or business license.
BUILDING/SITE
(1) 2.1 Ail subject colors and materials to be used on the new
*** classroom (former shade structure) shall be subject to
final review and approval of the Director of the
Community Development Department. All door and window
details shall match the existing two story building
adjacent to the shade structure. All exterior treatments
must be coordinated with regard to color, materials and
detailing as noted on submitted construction plans and
elevations shall indicate all colors and materials to be
used.

*** EXCEPTION
*** 2.2 The maximum enrollment of all Day Care/K-6 grade school
activities shall be 400 as set forth in Planning
Commission Resolution 1847. The applicant shall submit
written verification from the State permitting the
increase of enrollment prior to granting of building
permits.
PLAN SUBMITTAL
(1) 3.1 At building plan check four sets of construction level
plans shall be submitted as follows:

Construction plans, structural calculations, and
Title 24 energy calculations. Requirements of the
Uniform Building Codes, State Handicap accessibility
and Energy Requirement shall be complied with as
approved by the Building Official.
Be
Information to ensure compliance with all
requirements of the Orange County Fire Chief
including required fireflow and installation, where
required, of fire hydrants subject to approval of
the Fire Department, City of Tustin Public Works
Department and Irvine Ranch Water District and
compliance with all requirements pertaining to
construction.
(1) 3.2 Information to ensure compliance with all requirements
of the Orange County Fire Chief.
3.3 The following specific conditions shall be incorporated
into the construction plans at plan check.
Classroom Enclosure
*** A.
A fire alarm system shall be required, plan checked
and approved by the Orange County Fire Department.
Said system shall be operational and test approved
by the Fire Department prior to release of a
certificate of occupancy for the new classroom.
*** B.
The existing concrete slab shall be demolished to
pave the way for installation of a minimum sand and
new slab unless verification can be produced which
indicates that this installation has been made.

(1) c.
Ail new exterior walls for the enclosure shall have
continuous footings.
(1) D.
Applicant shall provide information from a soils
engineer related to any expansion soil
characteristics and said engineer shall sign the
slab and footing design.

Structural calculations for all lateral stability
due to enclosure.
*** F.
Building shall comply with Chapter 8 U.B.C. for
required light and ventilation, sanitary facilities,
and existing system.
*** G.
Ail exits shall be located at one half of diagonal
measured in a straight line of the area served.
(1) H.
Ail exterior mechanical equipment for the new
classroom shall be screened compatible with building
treatment.

I. Provide attic access per UBC Section 3305 or 7.
(1) J.
Note any lights to be installed on the elevations
of the classroom enclosure. All new lighting shall
be arranged so that direct rays will not shine on
adjacent properties.
(1) K.
Note on plans that all exposed metal flashing or
trim is either anodized or painted compatible with
main buildings.
(1) L.
Ail new utilities to serve the classroom shall be
installed or provided underground.
Miscellaneous
*** 4.1 The proposed basement library and computer room shall not
be utilized as a classroom facility or function without
*** 4.2 Unless otherwise modified by this Exhibit A of Resolution
No. 2768, all previous conditions of approval for the
church use contained in Resolutions No. 1847, 2401 shall
be complied with.

*** 4.3 Any asphalt pavement damaged by construction activities
shall e repaired and resurfaced as necessary for City
standards (.3 feet asphalt concrete over .5 feet
aggregate base).
(1) 4.4 Ail construction activities shall be subject to
provisions of the city of Tustin Noise Ordinance and
shall take place only during the hours of 7:00 a.m. to
6:00 p.m., Monday through Friday or other days and hours
which the Building Official determines is in substantial
conformance with the Noise Ordinance and the public
health and safety will not be impaired subject to
application being made at the time a permit for the work
is granted or during program on the work.
Basement Library and Computer Room Conversion

Plans shall comply with building codes, city ordinances,
and State and Federal law and regulations. This includes
Title 24 (e.g. energy and handicap accessibility, etc.)
If similar use is not proposed on ground level then
handicap accessibility is required.
FEES
(6) 6.1 Prior to the issuance of any building permits, payment
shall be made of all required fees including all
applicable plan check and building permit fees to the
Community Development Department.

The use applied for is consistent with
the Land Use Designation of the City's
General Plan which established the area
as Public and Institutional.
·
As conditioned, the proposed amendments
will not pose a threat to surrounding
uses in that the improvements will be
made on-site and not be visible from Red
Hill Avenue and that the shade structure
is existing and will only be enclosed to
create the classrooms. Additionally, the
basement is below grade beneath the
offices in the sanctuary. Maximum
enrollment and provisions for parking
will not be exceeded as previously
established in Resolution No. 1847.
II. The Planning Commission hereby approves Amendment No. 2
to Conditional Use Permits 87-7, authorizing 2,100 square
feet of basement to be converted into a library and
computer learning area, and approving Amendment No. 2 to
Conditional Use Permit 79-20 by permitting enclosure of
an existing 2,025 square foot shade structure in order
to create three pre-school classrooms on property located
at 13200 Red Hill Avenue, subject to conditions contained
in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 30th day of April, 1990.
