HomeMy WebLinkAboutPC RES 2762 1 2 3 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 -19 2O 21 22 23 25 26 27 28 RESOLUTION NO. 2762 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, DENYING CONDITIONAL USE PERMIT 90-08, A REQUEST TO CONSTRUCT A TWO AND ONE HALF STORY, 11 UNIT APARTMENT PROJECT THAT IS ADJACENT TO AND WITHIN 150 FEET OF AN R-l, SINGLE FAMILY RESIDENTIAL ZONE, TO BE LOCATED AT 15642 PASADENA AVENUE The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae A proper application, Use Permit No. 90-08 has been filed on behalf of Feridoun Rezai to request approval to construct a two and one half story, 11 unit apartment project that is adjacent to and within 150 feet of an R-i, single family residential zone, to be located at 15642 Pasadena Avenue. Ce Establishment, maintenance, and operation of the use applied for, under the circumstances of this case, will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: le The proposed project is not in conformance with existing single family residences located within 150 feet of or adjacent to the subject property, or with existing apartments on the east side of Pasadena Avenue (north and south of the subject property), as all of the single family residences are one story in height and the neighboring apartment projects are either completely one story in height or one story within 150 feet of the R-1 zoned properties. · The proposed project will impact the privacy of the adjacent single family residences as bedroom windows of the proposed apartments will be able to look down into rear yards of said residences. · The proposed project will cast shadows over the adjacent single family residences that will encompass a majority of the rear yards and in some cases, will often extend beyond the houses themselves into portions of the front yards. 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 9.4 25 26 27 28 Resolution No. 2762 April 30, 1990 Page 2 De The establishment, maintenance, and operation of the use applied for will be injurious or detrimental to the property and improvements in the neighborhood of the subject property, and to the general welfare of the City of Tustin, and therefore should not be granted. II. The Planning Commission hereby denies Conditional Use Permit 90-08 a request to construct a two and one half story, 11 unit apartment project that is adjacent to and within 150 feet of an R-i, single family residential zone, to be located at 15642 Pasadena Avenue.
