HomeMy WebLinkAboutPC RES 27333 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2733 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENdmENT TO USE PERMIT 73-18, AUTHORIZING RECONSTRUCTION OF AN EXISTING PLAY AREA FOR FRONTIER PARK. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A® That a proper application (Amendment to Use Permit 73-18) has been filed by the Community Services Department of the City of Tustin, to allow reconstruction of an existing play area for Frontier Park located at 1400 Mitchell. Be That a public hearing was duly called, noticed and held on said application on January 8, 1990. Ce That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: I · The use applied for is in conformance with the Tustin General Plan as the General Plan specifically list parks as a land use consistent with the Public and Institutional District. · The subject property is located in the Public and Institutional District and the use applied for has been established as substantially similar to those uses specifically listed as conditionally permitted uses in said district. · The proposed use will not negatively effect surrounding property owners, in that the improvements are for the use and pleasure of the surrounding properties. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2733 Page 2 D® That the est--]ishment, maintenance, and operation of the use applied fcr will not be injurious or detrimental to the prc~erty and improvements in the neighborhood oo the subject property, nor to the general welfare of the City of Tustin, and should be granted. Ee The project is Categorically Exempt pursuant to the provisions of Section 15304e (Class ~) of the California Environmental Quality ;ct. II. The Planning Commission hereby approves the amendment to Use Permit 73-15 to allow reconstruct%ion of an existing play area for Frontier Park located at 1400 Mitchell, subject to conditions contained within Exhibit A, attached hereto. RPeEcNoNIrd~nO~EsYecretar~ (1) (1) (1) (1) (3) EXHIBIT A AMENDMENT TO USE PLRMIT 73-18 CONDITIONS OF APPROVAL RESOLUTION MO. 2735 GENERAL 1.1 The proposed project shall substantially cgnformwi~h the submitted plans for the project date stamped Ja}'.~ary 8, 1990 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. 1.2 Unless otherwise specified, all conditions contained in this Exhibit shall be complied with prior to the issuance of any permits for the project, subject to review and approval by the Community Development Department. 1.3 Use Permit approval shall become null and void unless all necessary permits are issued within one year of approval of said application. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department thirty (30) days prior to expiration. 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits and or business license. BUILDING/SITE 2.1 All regulations of the Uniform Building Code and the Fire Department shall be met. 2.2 Any removal, reconstruction, or demolition of existing play area equipment shall require granting of applicable permits prior to any work.
