HomeMy WebLinkAboutPC RES 2730 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 25 26 27 28 RESOLUTION NO. 2730 A R?SOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA CERTIFYING THE NEGATIVE DECLARATION AS ADEQUATE FOR USE PERMIT 89-47 AND DESIGN REVIEW 89-68 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: A· Be Conditional Use Permit 89-47 and Design Review 89-68 is considered a "project" pursuant to the terms of the California Environmental Quality Act. A Negative Declaration has been prepared for this project and has been distributed for public review. Ce Whereby, the Planning Commission of the City of Tustin has considered evidence presented by the Ccmmunity Development Department and other interested parties with respect to the subject. Negative Declaration. D· The Planning Commission has evaluated the proposed final Negative Declaration and determined it to be adequate and complete. II. A Negative Declaration has been completed in compliance with CEQA and State guidelines. The Planning Commission, having the final approval authority over Use Permit 89-47, and the Community Development Department having final approval authority over Design Review has received and considered the information contained in the Negative Declaration prior to approving the proposed project and found that it adequately discussed the environmental effects of the proposed project. 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 2730 January 8, 1990 Page two On the basis of the Initial Studv and comments received during the public review pr:~ess, the P2. anning Commission has found that although the proposed project could have a significant effect on the environment, there will not be a sianifica~t effect on it in this case because m~tigation measures identified in the Negative Declaration have been incorporated into the pre,!eot which mitigate any potential significant env~-conmental effects to a point where clearly no s'.crificant effect would occur and are identified in Exhibit A to the attached Negative Declaration and Initial Study.
