HomeMy WebLinkAboutPC RES 2724 1 3 4 $ 7 8 10 11 13 14 15 16 17 18 19 '~1 ~2 25 ~6 ~7 RESOLUTION NO. 2724 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA APPROVING AN AMENDMENT TO CONDITION NUMBERS 9 AND 10 OF EXHIBIT 'A' TO RESOLUTION NO. 2543. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae Be Ce A proper application was submitted by the Sycamore Gardens Homeowner's Association requesting approval of an amendment to condition No.'s 9 and 10 of Exhibit 'A' to Resolution No. 2543, approving Variance 88- 10, which require making certain improvements prior to converting the Sycamore Gardens Stock Co-operative into condominiums. .. A public hearing was duly called, noticed and held for said application on November 13 and December 11, 1989. Resolution No. 2543, approving Variance 88- 10, was adopted on November 14, 1988. De In approving an amendment to condition No.'s 9 and 10 of Exhibit 'A' to Resolution No. 2543, the Planning Commission finds that it is appropriate to require repairs identified in Exhibit 'B', attached hereto, to be made to all units/structures at 'time of sale of dwelling units by individual owners. Repairs to common areas will be made by the Sycamore Gardens Homeowner's Association prior to completion of the conversion process. II., The Planning Commission hereby amends in their entirety condition No.'s 9 and 10 of Exhibit 'A' to Resolution No. 2543 to read as follows: "9. As a condition on the Certificate of Compliance to convert the Sycamore Gardens Stock Co-op to condominiums, the individual owner of each dwelling unit shall be required to perform all corrections and/or repairs identified in the Building and Pest Inspection Reports that are not violations of the Building Codes, attached hereto as Exhibit "A" and incorporated herein by reference, that 7 8 10 11 13 15 17 19 ~3 24 ~6 ~7 Resolution No. 2724 Page two pertain to their unit, prior to sale of said unit. The Building and Pest Inspection Reports shall also be attached to the Certificates of Compliance as an e>ik~bit. All violations of the Uniform Building, Plumbing, Electrical and/or Mechanical CoJes identified in the Building Inspection Re~ort ~hall be corrected or repaired by the individual owner of each affected unit within 180 days of the date of recordation of the Certificate of Compliance with final inspection to verify compliance by the Community Development Department. All necessary permits shall be obtained from the City prior to commencement of work. A second condition on the Certificate of Compliance shall identify those units that were not inspected for Building and/or Pest deficiencies. Buyers of uninspected units shall be required to have ~nspections made as a cc'~dition of sale. 10. The Sycamore Gardens Stock Cooperative Homeowner's Association shall perform all corrections and/or repairs to all common facilities identified in the Building and Pest Inspection Reports prior to recordation of the Certificate of Compliance. All necessary permits shall be obtained from the City prior to commencement of work. Ail other conditions in Exhibit A to Resolution No. 2543 shall remain in full force and effect." LESLIE PONTIOUS, Chairman EXHIBIT A AMENDMENT TO CONDITION NO.S 9 AND 10, RESOLUTION NO. 2543 VARIANCE 88-10 RESOLUTION NO. 2?24 l® · · · · · · The Building and Pest inspection reports (Exhibit B, attached hereto) shall be recorded against the deed of each individual dwelling unit within the Sycamore Gardens stock co-operative. Each unit owner shall perform the repairs to his/her unit as identified in Exhibit B, attached hereto and incorporated herein by reference. Said repairs and/or corrections shall be performed prior to the sale of the unit. All necessary building, plumbing, electrical and/or mechanical permits shall be obtained from the City prior to commencement of work. Each unit owner shall sign a copy of this Resolution evidencing their covenant to perform the repairs and/or corrections identified in condition No. 2 above. All signatures shall be notarized. The modification of this variance shall not be effective until all owners have signed the resolution as provided herein. The Certificate of Compliance shall state that the requirement to record the Building and Pest inspection reports against the deed of each dwelling unit within the Sycamore Gardens Stock Co-operative/Condominiums is a condition subsequent and that the covenants to repair or make corrections in accordance with Exhibit B, attached hereto and incorporated herein by reference, shall run with the land until satisfied. The Certificate of Compliance, with attached Exhibit B shall be recorded by the City for each unit created by the conversion. Ail repairs and/or corrections identified in Exhibit B, attached hereto and incorporated herein by reference, that occur at structures or facilities held in common ownership, shall be performed by the Sycamore Gardens Homeowner's Association prior to issuance of the Certificate of Compliance. All necessary building, plumbing, electrical and/or mechanical permits shall be obtained from the City prior to commencement of work.
