RESOLUTION NO. 2711
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF TUSTIN, CALIFORNIA,
APPROVING CONDITIONAL USE PERMIT 89-40,
AUTHORIZING TEMPORARY ESTABLISHMENT OF A
K-6 PRIVATE ELEMENTARY SCHOOL AT 1372
IRVINE BOULEVARD.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application (CUP 89-40) has been
filed by the Hope Christian Church, to allow
Colonial Bible Church School to operate' its K-6
private elementary school at 1372 Irvine Boulevard,
more specifically described as Parcel 2 of Parcel
Map 198-10.
That a public hearing was duly called, noticed and
held on said application on November 27, 1989.

That establishment, maintenance, and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, evidenced by the
~ollowing findings:

The use applied for is in conformance with the
Tustin General Plan as the General Plan
specifically list schools as a land use
consistent with the Public and Institutional
District.
·
The subject property is located in the Public
and Institutional District and the use applied
for has been established as substantially
similar to those uses specifically listed as
conditionally permitted uses in said district.
·
The proposed use will not negatively effect
surrounding property owners, in that the
nature of the use provides for minimal
vehicular activity during school hours and use
is temporary until the end of the academic
school year.

That the establishment, maintenance, and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in the
neighborhood of the subject property, nor to th,
general welfare of the City of Tustin, and shoul,
be granted.

The project is Categorically Exempt pursuant to the
provisions of Section 15303e (Class 3) of the
California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional Use
Permit 89-40, authorizing the temporary establishment of
a K-6 private elementary school at 1372 Irvine Boulevard
subject to conditions contained within Exhibit A,
attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin
Planning Commission, 'held on the 27th day of November, 1989.

CONDITIONAL USE PERMIT 89-40
CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped November 27,
1989 on file with the Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department in accordance with this
Exhibit. Exhibit A shall complied with as to areas
proposed not be used by the school for classrooms or
office use.
(1) 1.2 Unless otherwise specified, all conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Conditional Use Permit approval shall become null and
void unless all necessary building permits and business
licenses are issued prior to occupancy on the site by the
school use. The term of the Conditional Use Permit shall
be through July 1, 1990, at the conclusion of the 1989/90
academic year unless a time extension is granted. In the
event an extension is not granted the subject permit
shall' become null and void. Time extensions may be
granted by the Planning Commission if a written request
is received by the Community Development Department
thirty (30) days prior to expiration.
(1) 1.4 The applicant and property owner shall sign and return
an Agreement to Conditions Imposed form prior to the
issuance of any building permits and or business license.
(5) 1.5 Should the State or County require a day care license,
all applicable standards would have to be met.

USE RESTRICTIONS
The maximum enrollment of the school shall not exceed 167
children. This limit shall be appropriately identified
on the City business license and any other required State
or County licenses.
2.2 No permanent signs identifying said business shall be
permitted.
2.3 Ail children shall be escorted and checked into and out
of the school facilities. No children shall be left
unattended.
2.4 The applicant shall comply with the following:
i ·
Provide removable signs requiring one-way movement
into the site at the main drive entrance and no
exiting along Irvine Boulevard during operational
school hours of the school.
·
Install signage to prohibit parking in the first
four parking stalls on both the east and west side
of the main drive closest to the entry off of Irvine
Blvd. during operational hours.
·
Require employees of the school to park in the south
side parking area only and designate 14 spaces as
"employee parking only" with removable signs.
·
Permit a minimum of 21 90 degree loading and
unloading spaces on the west and east side of the
main drive (minus the prohibition on the use of the
four spaces closest to the driveway entrance) and
require six (6) additional 90 degree loading and
unloading parking spaces on the south side with
removable signage.
·
Ail proposed temporary traffic, directional and
parking restriction signage identified herein shall
be approved by the Community Development Department
and Public Works Department as to actual placement
location, appropriateness, design and durability.

BUILDING/SITE
(3) 3.1 Ail regulations of the Uniform Building Code and the Fire
Department regarding assembly occupancy classification
fire rating and exiting standards shall be met.
(3) 3.2 The full requirement of handicap access to a second story
building of Title 24 shall be waived for a period of one
(1) year from the date of this exhibit. Following said
date, if the elementary school still operates at said
Iocation than the site shall be brought into full
compliance with Title 24. -
(1) 3.3 Ail construction within public right-of-way shall be
shown on a separate 24" x 36" street improvement plan and
shall be approved by the Public Works Department prior
to any construction.
(5) 3.4 The building may be required to have an automatic
fire sprinkler system. A Letter of Intent as to which
parts'of the building will be used for school use shall
be submitted to the Orange County Fire Department for
further clarification.
(5) 3.5 A Class I type fire alarm system shall be installed. The
installation shall be approved by the Orange County Fire
Department.
(3) 3.6 Ail exit corridors shall be 1 hour rated with proper door
assemblies.
(3) 3.7 Occupancies for kindergarten, first or second grade
pupils, and division 3 occupancies shall not be located
above the first story (except in buildings equipped with
automatic fire sprinkler system throughout).
PLAN SUBMITTAL
4.1 At building plan check, three sets of construction level
plans shall be submitted as follows:

Plans shall specify all issues regarding occupancy
in accord with Orange County Fire Department and the
Building and Safety Division conditions.

(3) B.
The construction shall be in accordance with
applicable Building and Fire code including
installation of an alarm system as specified in
conditions of approval. Said construction will be
inspected by the Community Development Department
and Fire Department during construction and prior
to final.
(3) c.
Indicate that the full requirement of handicap
access to a second story building of Title 24 is
waived for a period of one (1) year from the date
of this exhibit and that following said date, if the
elementary school still operates at said location
then the site shall be brought into full compliance
with Title 24.
