HomeMy WebLinkAboutPC RES 2703 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 201 21 22 23 24 25 26 27 28 RESOLUTION NO. 2703 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 89-39, AUTHORIZING CONSTRUCTION OF AN EIGHT (8) FOOT TALL BLOCK WALL ALONG THE WESTERLY AND SOUTHERLY PROPERTY LINES OF PARCEL 1 OF PARCEL MAP 88-350. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application (CUP 89-39) has been filed by the Irvine Company to construct an eight (8) foot tall block wall along the westerly and southerly property lines of Parcel 1 of Parcel Map 88-350. Be That a public hearing was duly called, noticed and held on said application on November 13, 1989. Ce That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: le The use applied for is in conformance with the Tustin General Plan. · The subject property is located in the Planned Community Residential District and the use applied for is a conditionally permitted use in said District. · The proposed use will not negatively effect surrounding property owners, as the proposed eight (8) foot wall will serve as a screen buffer of the parked recreational vehicles. De That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 23 25 27 Resolution No. 2703 Page 2 The project is Categorically Exempt pursuant to the provisions of Section 15303e (Class 3) of the California Environmental Quality Act. II. The Planning Commission hereby approves Conditional Use Permit 89-39, authorizing the construction of an eight (8) foot tall decorative block wall along the westerly and southerly property lines of Parcel 1 of Parcel Map 88-350, subject to the following conditions: A, The proposed wall shall substantially conform with the submitted plans, date stamped November 13, 1989, on file with the Community Development Department, as herein modified or as modified by the Director of Community Development in accordance with these conditions. Be The maximum height of the subject wall shall not exceed eight (8) feet as measured from the lowest adjacent grade. Ce The subject wall shall be stuccoed and painted to match existing buildings and walls of the Laurelwood Condominiums. De Maintenance of the subject wall shall be the responsibility of the Laurelwood Homeowners Association. Ee Building permits shall be obtained prior to construction of the subject wall. Fe Ail applicable conditions of approval of Exhibits A and B to Resolution No. 2548, incorporated herein by reference, shall remain in full force and effect as they pertain to Parcel Map 88-350. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2703 Page 3 Ge The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of permits.
