RESOLUTION NO. 2673
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, APPROVING CONDITIONAL USE PERMIT 89-28,
AUTHORIZING ESTABLISHMENT OF APPROXIMATELY 7,500
SQUARE FEET OF AUTOMOBILE SERVICE SHOPS LOCATED AT 100
TUSTIN AVENUE.
The Planning Commission of the City of Tustin does hereby resolve as
follows'
I.
The Planning Commission finds and determines as follows-
A. That a proper application, (Use Permit No. 89-25) has been filed
on behalf of Park Abrams Development Company to authoriz~
establishment of a approximately 7,500 square feet of automobile
service shops on the property located at 100 Tustin Avenue and
described as Assessor's Parcel No. 400-091-013.

That a public hearing was duly called, noticed and held on said
application on September 25, 1989. ,
C. That establishment, maintenance, and operation of the uscI
applied .for will not, under the circumstances of this case,
be detrimental 'to the ..health, safety, morals, comfort, or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the followin.Cm
findings:
1. The use applied for is a conditionally permitted use wtthtr~
the C-2 (Central Commercial) District.
2. The use applied for is consistent with the Commercial Land
Use Designation of the City's General Plan.
3. Automotive repair type uses previously existed on the site
without conflict wi th surrounding uses.
D A Negative Declaration has been prepared in accordance with
California Environmental Quality Act.

II. The Planning Commission hereby approves Conditional Use Permit No.
89-28 to authorize establishment of a approximately 7,500 square feet
of automobile service shops, subject to the following conditions
contained in Exhibit A attached hereto and incorporated herein by
reference.

EXHIBIT A
CONDITIONS OF APPROVAL FOR CONDITIONAL USE
PERMIT 89-28
GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted site
plan for the project date stamped September 25, 1989 on file with the
Co,unity Development Department, as herein modified, or as modified by
the Director of Community Development Department in accordance with this
exhibit.
(1) 1.2 Unless otherwise specified, all conditions contained in this exhibit
shall be complied with prior to the issuance of a building permit for the
project, subject to review and approval by the Con~nunity Development
Department.
1.3 Use permit approval shall become null and void unless all building
permits are issued within one year of the date on this Resolution and
substantial construction is underway.
(1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed
form prior to the issuance of any building permits.
(1) 1.5 Al-1 utilities exclusively serving the site shall be r'emoved and replaced
underground.
PLAN SUBMITTAL
2.1 At building plan check, submit three sets of construction level plans as
fo 11 ows:

Construction and grading plans, structural calculations for
structures, buildings and tank installation shall be submitted. All
plans and calculations shall have wet signature of a licensed
engineer. Requirements of the Uniform Building Code, Uniform Fire
Code, National Electrical Code, South Coast Air Quality Management
District, Orange County Health Care Agency, and Orange County
Sanitation District shall be met.

Provide preliminary technical detail and plans for all utility
installations. Additionally, a note on plans shall be included
stating that no field changes shall be made without corrections
submitted to and approved by the Community Development Department.

C. Separate street improvement plans (24" x 36") shall be required for
all work within the public right-of-way and lall construction items
referenced to the City Standard drawing number. Information, plans
and/or specifications to ensure satisfaction of all Public Works
Department requirements including, but not limited to:
1. Construction or replacement of all missing or damaged public
improvement such as curb and gutter, sidewalk, wheelchair ramp,
A.C. pavement, street lights, drive aprons, street trees, and
underground utility connections.

O. Prior to the issuance of any building permits for combustible
construction, evidence that a water supply for fire protection is
available shall be submitted to and approved by the Fire Department.

Prior to the issuance of any building permits, plans for a
commercial fire extinguishing [ystem shall be approved by' the Fire
Department. Such systems shall be operational prior to the issuance
of a certificate of occupancy.

F. All construction shall be developed in accordance with the City's
Security Code.

G. The applicant shall dedicate additional right-of-way for a corner
cut-off to accommodate a handicap ramp per City Standard #124. The
applicant shall construct said ramp and make provisions for such on
the required street improvement plans noted below.
(3) 2.2 Exiting requirements for Space E shall be satisfied in accordance with
Section 3320 of the Uniform Building Code.
(3) 2.3 Details shall be submitted for air exchange of Spaces E & F in accordance
with Section 905 of the Uniform Building Code.
OPERATIONAL STANDARDS
*** 3.1 All mechanical work shall take place entirely within the building. No
vehicle repairs shall take place in any parking space or drive aisle.
*** $.Z All vehicles that are not being worked on within the building shall be
parked only within designated marked parking spaces. Absolutely no
parking shall be permitted in front of the roll up doors or any drive
aisle.

*** 3.3 All inoperative vehicles shall be parked within the building. Absolutely
no inoperative vehicles shall be permitted to be parked on-site ou-tside
of the building, including marked spaces.
(1) 3.4 No outdoor storage or display of materials of any kind shall be permitted
except as provided for by the City's Temporary Use Permit process for
special events.
(1) 3.5 All requirements of the City's Noise Ordinance (Chapter 6 of the
Municipal Code} shall be met at all times, which, in part, requires noise
levels not to exceed 60 dba at any time.
BUILDING/SITE
(4) 4.1 The parapet treatment on the west elevation shall be raised in height and
include consistent design treatment to match the other elevations.
(1) 4.2 The parapet shall be designed so that all mechanical equipment is located
{4) a minimum of 6" below the top of parapet.
(1) 4.3 Details of the trash enclosure including metal gate, and employees are in
the northeast corner of Space F shall be provided in the final working
drawings. Treatment for said items shall be consistent with the proposed
building treatment and applicable City standards and shall be subject to
final approval by the Community Development Director.
(4) 4.4 Proposed parking lot light standard bases shall be reduced in height from
3' to 1'-6" and shall include a stucco finish and paint to match the
building. The overall height of the parking lot lights shall not exceed
20 feet.
(1) 4.5 The proposed concrete wheel stops in front of the 6 compact spaces along
(4) the east elevation of Space C shall be removed and replaced with a 6"
continous concrete curb consistent with the City's parking lot land
Landscaping Development Standards. Landscaping shall' be added behind the
said curb area.
4.6 Proposed awning shall be of a canvas or similar opaque material and shall
not be illuminated from underneath.
LANDSCAPING
(1) 5.1 Submit at plan check, complete detailed landscaping and irrigation plans
for all landscaping areas consistent with adopted City of Tustin
Landscaping and Irrigation Submittal Requirements. Provide a summary
table applying indexing identification to plant materials in their actual
location. The plan and table shall list botanical and common names,
sizes, spacing, actual loction and quantity of the plant materials
proposed.

Show planting and bermlng details, soil preparation, staking, etc. The
irrigation plan shall show location and control of backflow prevention
devices, pipe size, sprinkler types, spacing and coverage. Details for
all equipment shall be provided. Show all property lines on the
landscaping and irrigation plans, public right-of-way areas, sidewalk
widths, parkway areas, and wall locations. The Department of Community
Development may request minor substitutions of plant materials or request
additional sizing or quantity materials during plan check. Note on
landscaping plan that adequacy of coverage of landscaping and irrigation
materials and replacement of existing landscaping in poor condition with
new landscaping is subject to field inspection at project completion by
the Department of Community Development.
(1) 5.Z Landscaped planters with a specimen tree and shrubs shall be provided in
front of the two single parking spaces adjacent to the roll up service
doors.
(1) 5.3 A specimen tree Shall be added to the planter area on the east side of

SIGMS
(1) 6.1 All slgnage shall be subject to a separate permit 'and shall be developed
in accordance with the City's Sign Code and conceptual criteria as part
of this approval.
The project name of "Tustln Plaza" shall be modified to remove reference
to "Tustin Plaza" as there is presently a development named "Tustin
Plaza" elsewhere in the City.
6.3 Monument sign copy (center name and tenant copy) shall be burgundy in
color consistent with the proposed awning color.
6.4 The individual tenant panel shall be recessed rather than raised to
provide a consistent design treatment.
6.5 A note shall be added to the individual tenant criteria that the letter
trims and returns shall be painted to match the sign face.

FEES
(6) 7.1 Prior to the issuance of any building permits, payment shall be made of
all required fees including, but not limited to:
A. Major thoroughfare and bridge fees to Tustin Public Works
Department.
B. Orange County Sanitation District No. 7 fees to the Sanitation
District.

New development fees to the Community Development Department.
All applicable plan check and building permit fees to the Community
Development Department.
School Facilities Fees to the Tustin Unified School District.
