RESOLUTION NO. 2660
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, APPROVING USE PERMIT 89-26 AUTHORIZING THE
RELOCATION OF AN EXISTING 670 SQUARE FOOT FREEWAY POLE
SIGN SERVING AN EXISTING RESTAURANT (REVERE HOUSE) DUE
TO THE WIDENING OF THE NEWPORT FREEWAY.
The Planning Commission of the City of Tustln does hereby resolve as
follows'
I. The Planning Commission finds and determines as follows'
A. That a proper application, (Use Permit No. 89-26) has been filed
on behalf of Donley-Bennet Architects requesting authorization
to relocate an existing 65 foot tall, 670 square foot, twin
support freeway pole sign serving an existing restaurant
(Revere House) due to the widening of the Newport Freeway.
B. That a public hearing was duly called, noticed and held on said
application on August 28, 1989.
C. That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort, or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
fi ndi ngs:
1. The sign has existed without any known problems or
complaints to the City.
2. The sign shall not be increased in size or height.
The new sign location on the site shall be a landscaped
planter area.
4. The sign relocation site shall be subject to the approval
of Caltrans and the Tusttn Public Works Department.
D. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should be
granted.
E. That the proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Codes as administered by the Building Official, Fire
Code as administered by the Orange County Fire Marshal and
street improvement requirements as administered by the City
Engineer.

F. That this project Is Categorically Exempt from the requirements
of the Ca]lfornla Envlronmenta] Quallty Act pursuant to Section
15311 (Class 11).
G. That final development plans shall require the review and
approval ofthe Community Development Department.
II. The Planning Commission hereby approves Conditional Use Permit No.
89-26 to authorize the relocation of an existing 670 square foot
freeway pole sign serving an existing restaurant (Revere House) due
to the widening of the Newport Freeway subject to the conditions
contained in the attached Exhibit A:

GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans for
the project date stamped July 27, 1989 on file with the Community Development
Department, as herein modified, or as modified by the Director of Community
Development in accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project,
subject to review and approval by the Community Development Department.
(1) 1.3 Use Permit approval shall become null and void unless building permits are
issued within twenty-four (24) months of the date on this Exhibit.
{1) 1.4 Approval of Use Permit 89-26 is contingent upon the applicant signing and
returning an "Agreement to Conditions Imposed" form as established by the
D1 rector of Community Devel opmen t.
1.5 Caltrans approval of the sign relocation site shall be submitted to the
Community Development Department prior to issuance of building permits.

2.1 At building plan check submittal'

Construction plans and structural calculations. Requirements of the
Uniform Building Code shall be complied with as approved by the Building
Official.

Preliminary technical detail and plans for utility installations
including electricity. Additionally, a note on plans shall be included
stating that no field changes shall be made without corrections submitted
to and approved by the Building Official. Undergrounding of all
utilities is required.

3. SITE AND BUILDING CONDITIONS

3.1 The actual final location of the sign may vary from the approved site plan
subject to the approval of the Community Development Department, Caltrans and
Public Works.
3.2 The sign shall be located in a landscaped p)anter in accordance with the
City's landscape standards.
3.3 All other proposed site alterations including but not limited to landscaping,
parking, and driveways shall be reviewed and approved by the Community
Development Department prior to issuance of building permits.
3.4 Prior to final approval of the sign permit, all repairs and maintenance shall
be made to the sign, sign faces, and sign exterior pursuant to Section 9443 of
the Tustin' Sign Code.
