HomeMy WebLinkAboutPC RES 2652 1 2 3 4 5 6 7 8 9 10 11 12! 13 14 15 1(; 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2652 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CONDITIONALLY APPROVNG DESIGN REVIEW 89-54 AND USE PERMIT 89-16 AUTHORIZING CONSTRUCTION OF AN 2,803 SQUARE FOOT EL POLLO LOCO FAST FOOD RESTAURANT WITH A DRIVE-THRU WINDOW AT 3002 EL CAMINO REAL. The Planning Commission of the City of Tustin does hereby resolve as fo l 1 ows: I. The Planning Commission finds and determines as follows: Ae That proper applications, (Design Review No. 89-54 and Use Permit 89-16), were filed on behalf of E1 Pollo Loco Restaurants requesting approval of a 2,803 square foot fast food restaurant with a drive-thru window at 3002 E1 Camino Real, in the Tustin Market P1 ace. B. That a public hearing was duly called, noticed and held on said application on August 14, 1989. Ce Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonius development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Size and spacing of windows, doors and other openings. 6. Towers, chimneys, roof structures, flagpoles, radio and television antennae. 7. Landscaping, parking area design and traffic circulation. 8. Location, height and standards of exterior illumination. e Location and appearance of equipment located outside of an enclosed structure. 10. Location and method of refuse storage. 11. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Proposed signing. 14. Development'Guidelines and criteria as adopted by the Cit) Counci 1. D. That establishment, maintenance, and operation of drive-thru window will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use applied for is in conformance with the East Tustin Specific Plan. , The site is located in the Mixed Use Land Use category of the East Tustin Specific Plan. 3. Then use applied for is a conditionally permitted use in the Mixed Use District. 0 The use will not create a noise nuisance as the proposed loudspeaker shall conform to the Tustin Noise Ordinance and shall be designed so as .not to impact adjacent commercial properties. . The project satisfies the East Tustin Specific Plan Parking Standards. 0 On-site traffic concerns, have been mitigated through the location and design of the drive-up window and aisle. E. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. The Planning Commission hereby conditionally approves Design Review 89-54 and Use Permit 89-16, authorizing construction of a 2,803 square foot fast food restaurant with a drive-thru window at 3002 E1 Camino Real in the Tustin Market Place subject to the conditions contained in Exhibit A, attached hereto. LESLIE ANN£ PONTIOUS Chairman · Recording Secretary DESIGN REVIEW 89-54 AND USE PERMIT 89-16 CONDITIONS OF APPROVAL RESOLUTION NO. 2652 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped July 24, 1989 on file with the Community Development Department, as herein modified, or as modified by the Director of Con~nunity Development Department in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Comnunity Development Department. (1) 1.3 Design review approval shall become null and void unless all building permits are issued within eighteen (18) months of the date of this Exhibit. (6) 1.4 Written approval of the Orange County Health Department approval is required prior to issuance of any permits. PLAN SUBMITTAL 2.1 At building plan check submittal: (3) A. Construction plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. (2) B. (3) Preliminary technical detail and plans for all utility installations including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. (2) (3) C. Final grading and specifications consistent with the site plan and landscaping plans and prepared by a registered civil engineer for approval of the Community Development Department. (2) (3) D. A precise soils engineering report provided by a soils engineer within the previous twelve (12) months as determined by the Building Official. (6) Information to ensure compliance with all requirements of the Orange County Fi re Chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department, City of Tustin Public Works Department and Irvine Ranch Water District and compliance with all requirements pertaining to construction as fol 1 ows: 1) A hood and duct fire extinguishing system is required over cooking areas in addition to required fire sprinklers. 2) Prior to issuance of any building permits for combustibl'e construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants shall be in place and operational to meet fire-flow prior to commencing construction with combustible materials. 2.2 Architectural plans shall not be submitted for plan check unless accompanied by a letter approving proposed design by the Irvine Company. SITE AND BUILDING CONDITIONS 3.1 The site plan shall be modified as follows: (4) A. (4) B. (4) .. (4) The .driver. thru lane entry shall be widened to 14 feet, tapering, down to 10'-6" with tapering location and geometrics subject to approval of the Community Development Department. Provide a parking tally noting 28 spaces required for this use in addition to maximum floor area caps for each use and corresponding available parking. Said tally shall address the entire Tustin Market Place and all tenancies to date inclusive of the proposed E1 Pollo Loco facility. C. The trash enclosure shall be constructed simultaneously with the subject restaurant and shall be completed prior to issuance of a Certificate of Occupancy. Said enclosure shall be built with solid concrete block wall§, have a stolit texture coat, solid metal gates and be painted to match the subject restaurant building. Said enclosure shall not be visible from E1 Camino Real. Do "Yield" and "Do Not Enter" signs shall be incorporated into the exit sign for the drive-thru lane. The design of all directory signs shall be consistent and compatible with the centers's directional traffic signs. Exhibit A Resol uti on No. 2652 Pa ge t h ree 3.2 Modify building elevations and proposed exterior materials as follows: A. Provide exact details for exterior doors and window types on construction plans. B. Colors used shall be only those approved on the applicant's sample board. No other colors are permitted. Red shall be used in insets on the front and rear elevations only. C. The base color for this building shall be the mid range tan, #2, as shown on the "7-10-89 Color Board". D, The use of exposed, red neon tubing is hereby approved for use, as shown, on the front elevation only. Said tubing is prohibited on all other elevations. Red neon is permitted only if red is used on the wall signage. E. Provide details for all lighting fixtures. Note locations on site plan and building el evati ohs'. Fixtures on building shall be of a decorative design. Freestanding fixtures shall be white with a sandblasted, exposed aggregate base to match project lighting. (1) 3.3 All exterior colors to be used shall be subject to review and approval of the (4) Director of the Community Development Department. All exterior treatments shall be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations shall indicate all colors and materials to be used. Building shall have a stolit texture finish on all exposed wall surfaces {building, canopy, walls, etc.) {1) 3.4 Note on final plans that a six foot high chain linked fence shall be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1) 3.5 All mechanical and electrical fixtures and equipment shall be adequately and (4) decoratively screened. The screen shall be considered as an element of the overall design of the project and shall blend with the architectural design of buildings. All telephone and electrical boxes shall be indicated on the building plans and shall be completely screened. (1) 3.6 Exterior elevations of the building shall indicate any fixtures or equipment {4) to be located on the roof of the building, equipment heights and type of screening. The six foot parapet, as shown on plans dated 8/14/89, shall screen all roof mounted equipment. Exhibit A Resolution No. 2652 Page four LANDSCAPING, GROUNDS AND HARDSCAPE ELET'ENTS (7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for - all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Said plans shall bear the approval of the landscape architect for the Tustin Market Place (POD). Provide summary table applying indexing identification to plant materials in their actual location. The plant table shall list botantical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices (located in inconspicuous area), pipe size, sprinkler type, spacing and coverage. Details for all equipment shall be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity of materials during plan check. Note on landscaping plan that adequacy of coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 4.2 The submitted landscaping plans at plan check shall reflect the following requirements- A. Turf is unacceptable for grades over 25%. A combination of planting materials must be used, ground cover on large areas alone is not · acceptable. B. Provide a minimum of one 15 gallon size tree for every 30 feet of property line on the property perimeter and five 5 gallon shrubs. Ce Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 8 feet on center when intended as screen planning. D. Ground cover shall be planted between 8 to 12 inches on center. E. When I gallon plant sizes are used the spacing may vary according to materials used. Fo Up along fences and/or walls and equipment areas, provide landscaping screening with shrubs and/or vines and trees on plan check drawings. G. All plant materials shall be installed in a healthy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condition, this will include but notI be limited to trimming mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. Major points of entry to the project, courtyards and pedestrian internal ci rcul ati on routes shal 1 receive specimen trees to create an identification theme. I. Landscape adjacent to the right-of-way shall be coordinated with parkway landscaping. Vines should be informally grouped with training devices installed. 4.3 Provide details, colors, and materials for outdoor patio area paving, tables, chairs, etc. These features shall be compatible with the building architecture and color and are subject to the approval of the Community Development Department. Provide samples on the col or and material board. SIGNAGE 5.1 Signage for this project is not approved with this Resolution. A revised sign program for the project shall be submitted for review and approval of the Comunity Development Department. Said program shall comply with all applicable provisions of the Master Sign Program for the Tustin Market Place, including but not limited to design, materials, illumination, sizes, etc. 5.2 A monument sign for this project shall be prohibited, pursuant to the Master Sign Program for the Tustin Market Place. 5.3 All directional signs for this project shall be designed consistent with such signage used elsewhere in the Tustin Market Place. FEES (6) (~.1 Prior to issuance of any permits, the applicant shall pay the following fees: A. All applicable plan check and permit fees. B. New development fees. C. School facilities fees to the Tustin Unified School District. D. Sewer and water fees to Irvine Ranch Water District. E. Major thoroughfare and bridge fees.
