HomeMy WebLinkAboutPC RES 2650 1 3 4 7 8 9 10 13 14 15 17 19 23 ~4 25 ~7 RESOLUTION NO. 2650 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RENEWING AND AMENDING CONDITIONAL USE PERMIT 87-29, AUTHORIZING THE INSTALLATION OF THREE (3) 8,000 GALLON UNDERGROUND STORAGE TANKS TO CONTAIN XYLENE, WASTER XYLENE, AND RESIN ON THE PROPERTY LOCATED AT 1123 WARNER AVENUE IN THE PC-IND DISTRICT. The Planning Commission of the City of Tustln does hereby resolve as fol 1 ow s: I. The Planning Commission finds and determines as follows: A. That a proper application, Amendment to Conditional Use Permit No. 87-29, has been filed on behalf of Steelcase to renew and amend Conditional Use Permit 87-29 to authorize installation of three (3) underground storage tanks to contain Xylene, waste Xylene, and Resin. B. That a public hearing was duly called, noticed and held on said application on August 14, 1989. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. That the use applied for is consistent with the Land Use Element of the Tustln General Plan as it pertains to industrial uses with applicable City and Fire Codes. 2. That the use applied for is consistent with the existing zoning regulations and development standards for the Irvine Industrial Complex as they pertain to installation of storage tanks which contain hazardous materials. 3. That measures to buffer the subject use from adjacent areas have been considered and have been incorporated in the plans. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. Eo Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, and Fire Code as administered by the Orange County Fire Marshal. F. The Planning Commission hereby renews and amends Use Permit No. 87-29 to authorize installation of three (3) new underground storage tanks to contain Xylene, waste Xylene, and Resin on the property located at 1123 Warner Avenue subject to the conditions contained in Exhibit A attached hereto and incorporated herein by reference, as submitted or revised: PASSED AND ADOPIED, at a regular~j~eeting of the Tustin P]~nnin Commissi held on the 14th day of August, 1989. PENNI FOLEY ~ Recording Secretary ~LESLIE ANNE PONTIUS Chairman RESOLUTION 2650 EXHIBIT A CONDITIONS OF APPROVAL FOR RENEWAL AND AMENDMENT TO CONDITIONAL USE PERMIT 87-29 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted site plan for the project date stamped August 14, 1989 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this exhibit shall be complied with prior to the issuance of a building permit for the project, subject to review and approval by the Community Development Department. 1.3 Use permit approval shall become null and void unless all building permits are issued within one year of the date on this exhibit. 1.4 Unless otherwise specified, conditions contained in this resolution shall be complied with prior to issuance of a building permit for the project, subject to review and approval by the Orange County Fire Department and the Community Development Department. 1.5 Planning Commission Resolution No. 2501 previously granted for installation of one underground storage tank and one above ground storage tank in a containment building is null and void. 1.6 The final working drawings shall be forwarded to the Planning Commission as an informational item prior to the issuance of any permits. PLAN SUBMITTAL 2.1 At building plan check, submit three sets of construction level plans as fol 1 ows: (3) A. Construction and grading plans, structural calculations for structures, buildings and tank installation shall be submitted. All plans and calculations shall have wet signature of a licensed engineer. Requirements of the Uniform Building Code, Uniform Fi re Code, National Electrical Code, South Coast Air Quality Management District and Orange County Health Care Agency shall be met. Provide preliminary technical detail and plans for all utility installations. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Community Development Department. C. The applicant shall comply wi th all requirements of the Orange County Fire Department, including required fire flow, installation where required of fire suppression systems subject to approval as to location by the Fire Department, and compliance with all requirements pertaining to construction. NOI~ (1) 3.1 All construction operations including engine warm up shall be subject to (2) the provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday unless the Building Official determines that said activity will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. FEES (1) 5.1 Prior to issuance of any building permits, payment shall be made of all (6) required fees including: A. Major thoroughfare and bridge fees to Tustin Public Works Department. B. Sanitary sewer connection fee to Orange County Sanitation District. C. All applicable Building plan check and permit fees to the Community Development Department. D. New development fees to the Community Development Department. E. School facilities fee to the Tustin Unified School District subject to any agreement reached and executed between the District and Steel case. Exhi bi t A Resolution No. 2650 Page three SITE AND BUILDING CONDITIONS (1) 1. All piping shall be internal and not visible on building elevations. (4) (1) 2. Note on plans that any new utilities serving site to be underground. Show all above ground locations for meters, transformers, manifolds and details for screening. (4) 3. The empty barrel storage area shall be reconstructed relative to area, screening, and fencing as presently existing in the same location and matching materials. o.
