A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 88-69
FOR A TWO ACRE PRIVATE PARK ON LOT 32 OF TRACT 12870
The Planning Commissi.gn qf the City of T~stin does hereby resolve as

C. Pursuant to Section q272 of the Tustin City Code, the Co,,qmi ssi on
finds tt~at the location, size, architectural featt~res and
general appearance of the proposed development will n~t impair
the orderly and harmonious development of the area, the present
or future development therein, or the occupancy as a whole. In
making sucl~ findings, the Commission considered at least the
following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and col ors.
4. Type and pitch of roofs.
5. Size and spacing of v~indows, doors and other openings.
6. Towers, chimneys, roof structures, flag poles, radio and
television antennae.
7. Landscaping, parking area design and traffic circulation.
8. Location, height, and standards of exterior illumination.
9. Location and appearance of equipment located outside of an
enclosed structure.
10. Location and method of reft~se storage.
11. Physical relationships of proposed structures to existing
structures in the neighborhood.
12. Appearance and design relationship of proposed str~ctures to
existing structures and possihle future structures in the
neighborhood and public thoroughfares.
13. Proposed signing.
14. Development guidelines and criteria as adopted b.y the City
Counci 1.

CONDITIONS OF APPROVAL
RESOLUTION NO. 2642
GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans for
tile project date stamped July 24, 1989 on file with the Community J)evelopment
Department, as herein modified, or as modified by the Director of Co~,~l~nity
Development Department in accordance with tt~is Exhibit.
(1) 1.2 Unless otherwise specified, the conditioqs contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project,
subject to review and approval hy the Co~q,.Jnity Develop,qent L)epartment.
(1) 1.3 Design review approval shall become null and void unless building permits are
issued within eighteen (18) months of the date on this Exhibit.
PLAN SUBMITTAL
2.1 At building plan check submittal:

A. Construction plans, structural calculations, and Title 2~ energy
calculations. Requirements of the Uniform Building Codes, State Handicap
and Energy Requirements sqall he complied with as approved by the
Building Official.

B. Preliminary technical detail and plans for all utility installations
including cable TV, telephone, gas, water and electricity. Additionally,
a note on plans shall be included stating that no fi eld changes shall he
made without corrections submitted to and approved by the Building
Official.

landscaping plans and prepared by a registered civil engineer for
approval of the Community Development Department.

Infor~nation, plans and/or specifications to ensure satisfaction of all

Five foot wide sidewalks adjacent to the curb along Gallery I.lay and
Rawlings !,Jay will be satisfactory, howevpr, the Street Improvement
Plans (R-1047 D, E and F) for those two streets will qee~.i to he
revised in that they indicate six (6) foot wide side;.,alks. The
proposed drive and any utility connections should also he sqown on
t~ese plan sheets. The site plan provided should be revised to show
the flares around the street li§hts and hydrants.
Tile driveway conflicts with the existin.(t street light plans on file
with the City. Such plans shall be revised as required and all
costs for such revisions shall be the responsil~ility of the
developer.

Additional right-of-way dedication will he needed to accommodate the
handicap ramp at Gallery and Rawlings I,~ay.

Ultimate owners of the Park shall be notified in writing of the
Assessment District 86-2 and the Tustin Lighting and Landscape
District Assessments.
Inforqation to ensure compliance witq all requirements of the Orange
County Fire Chief including required fireflow and installation, where
required, of fire hydrants subject to approval of the Fire ',]epartment,
City of Tustin Public Works Department and Irvine Ranch l.later District
and compliance with all req;~irements pertaining to construction as
fol 1 ows:
1) Any keys or pass cards intended for use hy the Fire and Police
Departments shall be placed in a Knox Box located near the entrance
to the facility according to Orange County Fi re Department
requirements.
2) To reduce the problems as discussed above, proper signs shall be
posted on the site designating the park as private and warning of
trespass violations at all facility gates and the parking lot entry.
Detailed plans for pool and spa areas must be reviewed and approved by
the Orange County Health Department. All pool and spa areas must be
enclosed by a minimum five (5) foot high fence with self-closing and
latching gates with access by key only and with vertical openings no
greater than 6".

SITE AND BUILDING CONDITIONS
3.1 Consideratinn shall he given to rough plu,qhing to retain future solar heating
options for recreation and pool areas. Copper shall be installed from hot
water closet and the hot water closet shall be adequate in size to accommodate
a solar water heater and addition of a 110v electical outlet.

architectural design of buildings. All electrical boxes shall he indicated on
the building plans and shall be completely screened. Electrical transformers
shall be located toward the interior of the project maintaining a sufficient
distance from frontage of the project.
(1) 3.5 Submit detail for all on-site walls to be constructed by developer including
(3) walls within interior of project. Show type of wall cap and type of color,
(4) exterior materials on subdivision walls which should he consistent with wall
concepts approved for Tract 12780 and decorative treatment of all exposed

where there is more than a thirty (30) inch drop. Check the building code and
provide details for such treatment. Provide wall/fence legend on site plan.

LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for

Earth mounding is essential and must be provided to applicable heights
whenever it is possible in con,iunction with the submitted landscaping
plan. Earth mounding should be particularly provide along the Ra~.~lings

4.3 Screening adjacent to roadways, whenever possit~le, st~all compliment the
architecture, color and construction material of primary buildings on the
site.
4.4 Pedestrian ~.~alkways should be separated from traffic areas wl~ere possible to
provide a separate circulation system. ',.!hen necessary and practical, the
separation sho,~ld include landscaping and other barriers.
llalkways, whenever possihle, shall pass througt~ the interiors of blocks; where
they cross street corners, adequate site distance shall he provided.

4.5 All walls, fences or landscaping adjacent to Lots along the interior property
line should he desi~.ined to provide adequate sight distance for vehicles
exiting tile tract via the private driveway.
