A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 88-68
FOR A TWO ACRE PRIVATE PARK ON LOT 31 OF TRACT 12870
The Planning Commission of the City of Ttlstin does hereby resolve as
fol 1 ows:
I. The Planning Commission finds and determines as follows:
A. That a proper application, Desi(.jn Review g,,q-58, was filed hy the
Irvine Company requesting approval of a two acre private park.
That the Commission considered the project in a regular meeting
eld on July 24, 19.59.

Pursuant to Section q272 of the Tustin City Code, the Commission
finds that the location, size, architectural features and
general appearance of the proposed development will not impair
the orderly and harmonious development of the area, the present
or future development therein, or the occupancy as a whole. In
making such findings, the Commission considered at least the
following items:
1. Ileight, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and col ors.
4. Type and pitch of roofs.
5. Size and spacing of windows, doors and other openings.
6. Towers, chimneys, roof structures, flag poles, radio and
television antennae.
7. Landscaping, parking area design and traffic circulation.
8. Location, height, and standards of exterior illu,qination.
9. Location and appearance of equipment located outside of an
enclosed structure.
1(I. Location and method of refuse storage.
11. Physical relationships of proposed structures to existing
structures in the neighborhood.
12. Appearance and design relationship of proposed structures to
existing structures and possible future structures in the
neighborhood and public thoroughfares.
13. Proposed signing.
14. [~evelopment guidelines and criteria as adopted by the City

CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conf()rm with the submitted plans for
the project date stamped July 24, lq39 on file with the Com,qunity ,~evelopment
[}epartment, as herein modified, or as ~qodified by the i~irector ,of Co,~unity
Oevelopment I~epart,qent in accordance wit~ this E×hibit.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior ~o the issuance of any building permits for th~ project,
subject to review and approval by t.he Co,~,~unity i~velop~.~ent ~)epartment.
(1) 1.3 Design review approval shall become null and void unless buildin§ permits are
issued within eighteen (18) months of the date mn this Exhibit.
PLAN SUBMITTAL
2.1 At building plan check submittal:

Information, plans and/or specifications to ensure satisfaction of all
Public Works Department requirements including but not limited to:
1)
Five foot wide sidewalks adjacent to the curb along Greenway Drive
and La Colina Drive will he satisfactory, however, the Street
Improvement Plans (R-1047 D, E and F) for those two streets will
need to be revised in that they indicate six (6) foot wide
sidewalks. The proposed drive and any utility connections should
also be shown on these plan sheets. The site plan provided should
be revised to show the flares around the street lights and hydrants.
2)
The driveway conflicts with the existing street light plans on file
with the City. Such plans shall he revised as required and all
costs for such revisions shall be the responsibility of the
developer.
3) Additional right-of-way dedication will be needed to accommodate the
handicap ramp at Greenway Drive and La Col ina Drive.
4) Ultimate owners of the Park shall be notified in writing of the
Assessment District 86-2 and the Tustin Lighting and Landscape
I)istrict Assessments.
Information to ensure compliance with all requirements of the Orange
County Fire Chief including required fireflow and installation, where
required, of fire hydrants subject to approval of the Fire Department,
City of Tustin Public Horks Department and Irvine Ranch ;.later District
and compliance with all requirements pertaining to construction as
fol 1 ows:
1) Any keys or pass cards intended for use by the Fire and Police
Departments shall be placed in a Knox Box located near the entrance
to the faci 1 ity according to Orange County Fi re Depart~.qent
requirements.

To reduce the problems as discussed above, proper signs shall be
posted on the site designating the park as private and warning of
trespass violations at all facility gates and the parking lot entry.
Detailed plans for pool and spa areas ~.nust be reviewed and approved by
the Orange County Health Department. All pool and spa areas must be
enclosed by a minimum five (5) foot high fence with self-closing and
latching gates with access by key only and with vertical openings no
greater than 6".

SITE AND BUILDING CONDITIONS

3.7 The location of the SCE transfor~.~er (vault) has not be shown on the plans, and
shall not he located in setback areas. The location of the transformer shall
be reviewed and approved by the Community Development Department prior tn
installation.
3.8 The materials, and col ors of the co,nbination wall used on the interior
property line shall match those provided on the building or adjacent projects,
whichever is preferred.
3.9 The homeowner's associations who will have control river the site will be
required to have liability insurance for the facility. Additionally, all of
the CC&R's for each of the projects ,nust include a detailed description of the
legal responsibilities, ownership, and ,naintenance responsibilities (including
maintenance standardsl for the site. A stan.,tard CC&R package must be prepared
prior to Final Iiap approval for Lots 9, 1[}, 11 and 12 of Tract 12870.
3.10 Any and all applicable conditions of Resolution No. 2346 for Tract 12870 which
affect this project shall be compiled with prior to issuance of building
permits.
3.11 If construction is completed prior to approval o.f the Final Tract I.~aps for all
of the residential projects on Lots g, 10, 11 and 12 of Tract 12870, the
applicant shall maintain the site until such approval is granted.
LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for
all landscapin(j areas consistent with adopted City of Tustin Landscaping and
Irrigation Submittal Requirements. Provide summary table applying indexing
identification to plant materials in their actual location. The plan and
table must list bo~antical and common names, sizes, spacing, actual location
and quantity of the plant materials proposed. Show planting and berming
details, soil preparation, staking, etc. The irrigation plan shall show
location and control of backflow prevention devices, pipe size, sprinkler
type, spacing and coverage. [)etails for all equipment must be provided. Show
all property lines on the landscaping and irrigation plan, public right-of-way
areas, sidewalk widths, parkway areas, and wall locations. The Department of
Com~qunity Development may request minor substitutions of plant materials or
request additional sizing or quantity materials during plan check. Note on
landscaping plan that coverage of landscaping irriqation materials is subject
to field inspection at project completion by the Department of Community
Development.
(7) 4.2 The submitted landscaping plans at plan check m~st reflect the follo~.~ing
requirements:
Turf is unacceptable for grades over 25%. A combination of planting
materials must be used, ground cover on large areas alone is not
acceptable.
