HomeMy WebLinkAboutPC RES 2610 1 2 3 5 10 11 12 13 1'3 17 18 19 21 23 2'4 27 28 RESOLUTION NO. 2610 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING USE PERMIT 89-17, AUTHORIZING A TYPE 40 (ON-SITE SALE OF BEER) AND TYPE 47 (ON-SITE SALE OF GENERAL LIQUOR) ALCOHOLIC BEVERAGE LICENSE FOR THE TUSTIN RANCH GOLF CLUB AT 12442 TUSTIN RANCH ROAD. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application (Use Permit 89-17) has been filed by the Irvine Company requesting authorization for on-site sale and consumption of beer during temporary operations (Type 40 license) and general liquor (Type 47 license) once permanent operations commence, at the Tustin Ranch Road Golf Club located at 12442 Tustin Ranch Road. B. A public hearing was duly called, noticed and held for said application on May 22, 1989. C. Establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: 1. The use applied for is in substantial conformance with the adopted guidelines for alcoholic beverage sales establishments. 2. The use applied for is a conditionally permitted use in the Golf Course land use category of the East Tustin Specific Plan. 3. The unique characteristics of a golf course warrant considering the entire course as the "premises" for purposes of allowing sales and consumption on the course itself, since access to the course is limited to a single entry drive. 4. The golf course will be an operating facility prior to the occupancy of any of the adjacent residential developments, thereby allowing future residents to have prior knowledge of the operations of said course. O 8 9 10 11 12 13 14 15 Resolution No. 2610 Page two D. 5. Alcohol sold on the premises shall be for on-site consumption only. The establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. This project is Categorically Exempt pursuant to Section 15303{c) (Class 3) of the California Environmental Quality Act. II. The Planning Commission hereby approves Use Permit 89-17, authorizing on-site sale and consumption of beer only (Type 40 license) during temporary operations and general liquor {Type 4,~ license) once permanent operations commence at the Tustin Ranch Golf Club located at 12442 Tustin Ranch Road, subject to the conditions contained in Exhibit 'A', attached hereto. 16 17 22! ~enni Foley Secretary 23 27 PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 22nd day of May, 1989. ! -~CCh' airman EXHIBIT 'A' USE PERMIT 89-17 TUSTIN RANCH GOLF CLUB CONDITIONS OF APPROVAL RESOLUTION NO. 2610 i · All alcoholic beverages shall be consumed on-site (Lots 29 and 30 of Tract 12870). · Approval of the Type 40 license shall be effective from July 7, 1989 through the issuance of a Certificate of Occupancy for the permanent clubhouse faci 1 i ry. · Sale of beer under the Type 40 license shall occur from the temporary clubhouse and beverage carts parked at the 5th and 13th tees only. 4. Approval of the Type 47 license for general liquor shall become effective with the issuance of a Certificate of Occupancy for the permanent clubhouse faci 1 i ry. 5. All persons selling alcoholic beverages shall be a minimum of 18 years of age and shall be supervised by someone of 21 years of age or older. Supervisors shall be present in same area as point of sale. Operation of mobile beverage carts shall be by persons of a minimum of 21 years of age. 6. Hours of sale of alcoholic beverages for the type 40 and 47 licenses shall be 6:00 a.m. to closing. Under no circumstances shall alcoholic beverages be sold after 2:00 a.m. 7. Authorization for on-site sale and consumption of general liquor is contingent upon the permanent clubhouse facility containing restaurant facilities. At such time as restaurant use is discontinued, this use permit shall become null and void. 8. The menu of the permanent restaurant shall consist of foods that are prepared on the premises. 9. There shall be no pool tables or coin operated games on the premises at anytime. 10. The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of permits for the temporary facilities.
