2 - AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
AMENDING THE ZONING ORDINANCE NO. 157, AS AMENDED
~ TO PROVIDE FOR A DEVELOPMENT PREVIEW COMMITTEE.
5 The City Council of the City of Tustin, California_, does=
6 ordain as follows':
Section 1: The Zoning Ordinance of the City of Tustin,
Ordinance No. 157, as amended, is hereby amended by the deletion
8 therefrom of Sections 5.230, 5.240, 5.250, 5.260, 5.270 and 5.280,
all relating to Architectural approval.

Section 2: The Zoning Ordinance of the City of Tustin,
10Ordinance No. 157,, as amended, is hereby amended by the addition
thereto of the following:

~ection 5'.2'30 DEVELOPMENT PREVIEW COMMITTEE

1,. The purposes of the Development Preview Committee shall'
13 be:
14 a) To provide for the review of building design,
site planning and. site development in order to
15 protect the increasing'value, standards and
importance of land and deve~opmen~ in the City
16 due to the urbanization of Orange County.
1? b) To retain and strengthen the unity and order of
the visual community.
c) To insure that new uses and structures enhance
19 " their sites and are harmonious with the highest
standards of improvements in the surrounding
20 area and total community.
~1 2. The City Council finds that poor quality in the exterior
design~ development and maintenance of structures, landscaping and
22 general appear'ance affects the desirability of the neighboring area
and the con~unity as a whole, and impairs the benefits of both po-
23 tential and existing occupancy of other properties to the detriment
of the public health, safety, comfort and general welfare.

3. The City Council further ~inds that quality evaluatiors
25 are necessary to fully accomplish the purpose of regulations de-
signed to control such.matters, since such regulations cannot both
26' allow reasonable lati~Ude~for diversity and originality of, design
and still be specific enough to control all the aspects of the dif-
27 ferent uses.that can adversely affect the conm~unity.
28 $ec.t.iqn 5.240 APPOINTMENT OF DEVELOPMENT PREVIEW COF~ITTEE
The City Council shall appoint a Development Preview Com-
mittee which shall consist of five (5) members selected-from at leas~
30 three (3) of the following groups:
5i 1. Licensed Architects or Building Des~gners~
5Z 2..Registered Landscape Architects.

1 ~ ~. Persons associated with the Real Estatee~i
Building Industries having had demonstrated
· Z experience in .the visual arts.

5 4. Any other group, the selectee from which --
".the City Council at its discretion determines
'4 could significantly contribute to accomplishing
the stated'goals of the Development Preview
5 Committee.
6 The City Council shall in~ite the TUstin Chamber of Com-
merce to submit £our (4) names from any combination of the above
7 groups,..from which the Council may appoint one (1) member to the
Committee.

~ Alternate members of similar qualifications'shall be ap-
9 pointedto serve in the absence of regular members.
10' Committee members shall be appointed for two (2) year
staggered terms. Of the'first members appointed, two (2) members
11 shall be appointed for a one (1) year term and three (3) members
shall be appoihted for a two (2) year term. Thereafter each member
1~ shall be appointed for a two (2) year term. Compensation shall be
set from time to time. as~determined by the Council.
SECTION 5. 250 SCOPE~= OF JURISDICTION _O~ .DEVELOPMENT PREVIEW
15 Prior to the issuance of a building permit for any
multiple family, commercial, industrial or p~lic use, including new~
16 structures or major exterior alteration or enlargemeht of existing
structures, buildings to be"!rel.ocated, and signs the Development
I~ Preview Commit=tee shall approve the Site' Plan, Elevations and Land-.°.:;
scaping Plan for such development. The Committee shall also review
18 plans for single family residential structures which 'are the subject~
- of a Use Permit or a Variance, when so directed by a~tion of the
19 Planning Commission. (Formal action on Use Permits, Variances. Zone}
Changes and Prezoning=~is under the jurisdiction Of the Planning Com-~
20 mission and the City Council.) '
~1 ~ECTION 5.260 CONDITIONS .OF~APPROVAL
22 The Committee shall approve the submitted pIans if it finds
that the location, size, architectural features and general appear-
23 ance of the pr'oposed development wall-not impair the orderly and
harmonious development of the area, the present or future developmen%
Z4 therein, the occupancy thereof, or the community as a whole. In
making such findings, the committee shall consider the following

2. Setbacks and site planning. I..
27 3. Exterior materials and colors.
4. Type and pitch of roofs.. .
28 5. Size and spacing of windows, doors and
other openings.
i29 6. Towers, chimneys, roof structures, flag-
poles, radio and'television antennae.
30 7. Landscaping, parking area design and traffic
circulation.

..S.E~CTION 5.270 APPLICATION., ACTION AND TIME LIMIT
Applications for Development Preview shall be made on forz
8 provided by the Planning Department, together with two. (2) sets of
preliminary drawings, at least one (1) day prior to the day of the
9 meeting at which said preliminary drawings are to be considered..
The decision of the Development Preview Committee shall be final
10' unless appealed, in writing, stating the reasons for said appeal,
to'the City Council, within fifteen (15) calendar days of the date
11 of the action taken by the Committee.
12 The action of the Development Preview Committee shall be
effective for eighteen (18) months, at the end of which time, if:the
13 building (or buildings) is (are) not completed' or under construction'
a new application must be made and the review process repeated.
SECTION 5. 280 GUIDING PRINCIPLES

Implementation of the development 'previews processes -
16 relative to external design shall be guided. by' the following princi-
ples:
1. Individual initiative shall be encouraged. Control
18 shall be reduced to the minimum extent possible,
- while insuring that the goals stated in this Ordi-
19 nance are achieved to the fullest possible extent~
20 2. Good architectural character is based upon the suit-
ability of a structure for its purposes; upon the
21 ==- appropriate use of sound materials and upon the
principles of harmony and proportion in the elements
22 of the structure o
23 3. GOod architectural character is not, in itself, more
costly than poor architectural character and-is not=
24 dependent upon the particular style of architecture
selected.

4. When considering-signs, particular attention shall
26 be given to incorporating the design, including
colors, of the sign into"~the over-all design of the
27 entire development, so as to achieve homogeneous
development. . -
5. Buildings' to be relocated must be previewed as to
29 their compatibility with neighboring structures and
with existing or proposed structures on the same site.

PASSED AND ADOPTED at a regular meeting of the City Council of the
