HomeMy WebLinkAboutPC RES 2588 1 3 6 7 9 10 11 13 14' 16 2(~ ~3 ~4 26 RESOLUTION NO. 2588 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 89-12 FOR OVER 50% OFFICE USE TO ACCOMMODATE A SPORTS MEDICINE CENTER IN THE C-1 (RETAIL COMMERCIAL) DISTRICT AT 14692/14702/14772 NEWPORT AVENUE. The Planning Commission of the City of Tustin does hereby resolve as fol 1 ow s' I. The Plannin§ Commission finds and determines as follows' A. That a proper application, (Use Permit 89-12) has been filed on behalf of Physician's Office Services to request authorization for over 50% office use to accommodate a sports medicine center in the C-1 (Retail Commercial) District at 14692/14702/14772 Newport Avenue. B. That a public hearing was duly called, noticed and held on said application on April 24, 1_oB9. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: 1. Development of professional and general office buildings to accommodate a sports medicine center would be more co~atible with surrounding uses in the area than permitted retail commercial uses in that the proposed use would be compatible with the Healthcare Medical Center immediately to the north. 2. The proposed use is in conformance with the General Plan and Zoning Code. 3. The use applied for is a conditionally permitted use in the C-1 (Retail Commercial) District. 4. The proposed project will significantly upgrade the appearance of the property and neighborhood. 5. The proposed project will reduce traffic in the area and improve circulation in the area by consolidating the many drive approaches on Newport and Sycamore Avenues that presently serve these properties. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. 5 6 8 9 10 11 13 14 1'5 16 17 19 ~3 ~4 ~5 26 Resolution No. 2588 Page two Proposed development will be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fi re Marshal and street improvement requirements as administered by the City. Engineer. F. A Negative Declaration has been prepared for this project in conformance with the California Environmental Quality Act. II. PENNI FOLEY Recording Secretary EXHIBIT A CONDITION/U_ USE PERMIT 89-12 CONDITIONS OF APPROVAL RESOLUTION NO. 2588 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped April 24, 1989 on file wi th the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. --(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Use Permit approval shall become null and void unless building permits are issued within twelve {12} months of the date on this Exhibit. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any building permits. (3) (2) (3) (1) (2) (5) (1) PLAN SURM Il-[AL 2.1 At building plan check submittal: A. Provide construction plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. B. Preliminary technical detail and plans for all utility installations including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. Street trees h. Underground utility connections Separate street imrovement plan {24" x 36" sheet) is required for all work within the public right-of-way and all construction items referenced to the City StandarO drawing number. D. Additional information shall be included on the final working drawings as follows: 1. The legal description, address, and zoning designation of the subject properties. 2. The total lot area by parcel, lot dimensions, and existing improvements and utilities in the public right-of-way. 3. Dimensioned floor plans with a description of the proposed uses for different spaces in the building and square footage and estimated number of employees by functional area. 4. Floor area calculations and lot coverage by building/parcel. 5. Details for handicap spaces and parking lot stripping. e Specify paving materials for pedestrian circulation areas which shall be consistent with the treatment at the Healthcare Medical Center. Location of all exterior mechanical equipment and roof mounted equipment. 8, A complete landscaping and irrigation plan with lists of plant names {common and botanical), size, quantities, locations, irrigation materials and layout, location of backflow preventors and automatic timers. Said plans shall be in accordance with the City's Landscaping and Irrigation Submittal Requirements. Resolution No. 2588 Exhibit A Page three SITE AND BUILDING CONDITIONS (5) 3.1 The applicant shall dedicate, or provide an irrevocable offer of dedication, for an additional 10 feet of right-of-way along the Sycamore Avenue frontage, along with the appropriate corner cut-off in accordance with the City's Master Plan of Highways. {2) 3.2 The applicant shall provide a reciprocal ingress and egress easement on and between the subject properties and property to the north to facilitate vehicular movement between said properties in areas only as designated on the approved site plan. (1) 3.3 All utilities exclusively serving the site shall be provided underground. (4) 3.4 The project shall be parked in accordance with the clinic ratios pursuant to City Code Section 9232(c)(2)(f) which would require a minimum of 45 standard parking spaces. Minimum standard stall size shall be 9' x 20' (2.5' overhang into a landscaped area is permitted). (4) 3.$ The canopy/arcade architectural element shall be carried around to the south elevation of the clinic building (facing Sycamore Avenue) to provide architectural integrity to this corner. (1) 3.6 Parking lot light standards shall be decorative in design to match the (2) Healthcare Medical Center and shall be in conformance with the City's Security (4} Codes. Precise locations, fixture details, and lighting intensity shall be reviewed in the final working drawings. 3.7 Each parcel shall have at least one trash enclosure. The locations, size, and quantities of bins shall be reviewed and accepted by Great Western Reclamation. The location identified on the plans at the service drive is inappropriate and shall be located elsewhere on the site. (1) 3.8 Trash enclosure details shall match the treatment of the main building and (4) shall be reviewed in the final working drawings. (4) 3.9 All existing and proposed boundary walls shall be stuccoed and painted to match the main building. (1) 3.10 A complete sign program shall be prepared for the project which compliments the Healthcare Medical Center Sign Program and shall be approved prior to the issuance of any Certificate of Use and Occupancy for the project. ~esolution No. 2588 Z xhi bi % A '~age four FEES J , (1) 4.1 Prior to the issuance of any building permits, payment or verification of payment, shall be made of all required fees, including but not limited to the fol 1 owi n g: a. Applicable building and grading plan check and permit fees to the Community Development Department. b. Applicable new development fees to the Community Development Department. c. Applicable school facilities fees to the Tustin Unified School District. d. Applicable City of Tustin or Orange County Sanitation District No. ? sewer connection fees. e. Required fees for the Major Thoroughfare and Bridge Fee Program. f. Applicable East Orange Water District fees. g. Applicable Circulation Improvement fees, per Ordinance 930, to the Public Works Department.
