I 21 22 23 27 28 RESOLUTION NO. 2568 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING USE PERMIT 89-04 ALLOWING THE STORAGE OF FIREWOOD, VEHICLES AND SUPPORT EQUIPMENT FOR B & J TREE SERVICE AS WELL AS THE SALE OF F I REWOOD. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines: A. That a proper application has been filed by Mr. Bobby Gilbert on behalf of B & J Tree Service requesting approval of a Use Permit to allow the continuation of the storage of firewood, vehicles and support equipment as well as the sale of firewood on the property located at 1062 E1 Camino Real. B. That a hearing was duly held on February 27, 1989 for said appl i cati on. C. That the proposed use is Categorically Exempt {Class 4) pursuant to Section 15304 of the California Environmental Quality Act. D. That establishment, maintenance, and operation of the proposed use will not, under the circumstances of this case, be detrimental or injurious to the property, health, safety, morals, comfort, or general welfare of the persons residing or working in the vicinity of said proposed use, evidenced by the following findings: 1. That the subject property is physically able to accommodate the proposed use. 2. That E1 Camino Real is capable of handling traffic to the subject site, and access to the site is available through two (2) existing, 33 foot wide driveway curb-cuts. 3. That all potential, adverse impacts associated with the use will be mi ti gated by the conditions contained herein. II. The Planning Commission hereby approves Use Permit 89-04 to allow the storage of firewood, vehicles and support equipment as well as the sale of firewood for B & J Tree Service, on the property located at 1062 E1 Camino Real, subject to the following conditions: A. This Use Permit shall expire when Caltrans possesses the property for freeway widening or the date Certificates of Occupancy are issued for the LA Land Company project at 1011 E1 2 3 4 5 6 8 9 10 12 13 14 15 17 18 20 21 22 Resolution No. 2568 Page two Camino Real, whichever occurs first. B. The applicant shall maintain the six (6) foot high cyclone (chain link) fence around the perimeter of the subject property, except along the southerly property line. C. Firewood shall not be stacked above the height of the fencing, and shall comply with the requirements of the Fire Marshal for stacking of combustible material. D. Gravel shall be maintained as presently installed at each Uti veway. E. All vehicles and support equipment shall be stored at the rear of the subject property, along the midpoint of the rear property line. Inoperable vehicles shall not be stored on this property. F. The appl.icant shall retain or provide renewal of the $2,000 bond to ensure clean-up of any and all mud and debris tracked onto E1 Camino Real by said vehicles and equipment and/or customer vehicles. G. Hours of firewood sales shall be limited to 8 a.m. to 6 p.m., i.~ seven (7) days a week. H. Approval of this Use Permit is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 23 28] Secretary I. The applicant shall retain the "Entrance" and "Exit" signs at the site to coordinate traffic movement. J. Chipping operations shall be prohibited on the subject property.
