HomeMy WebLinkAboutPC RES 25643 4 7 8 9 10 11 12. 14~ · ~ 19 21 22 23 25 27 28 RESOLUTION NO. 2564 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING USE PERMIT NO. 88-30 AUTHORIZING LOCATION OF A PASSIVE FITNESS PARLOR/HEALTH CLUB AT 13721 NEWPORT AVENUE, SUITE 15 The Planning Commission of the City of Tustin does hereby resolve as fol 1 ow s' I. The Planning Commission finds and determines as follows' A. That a proper application, Use Permit 88-30 has been filed by Ms. Susan Riddle and Ms. Judy Budzenski on behalf of Inches Away, requesting authorization to locate a passive fitness parlor/health club at 13721 Newport Avenue, Suite 15, in the Tustin Plaza Shopping Center. B. That a public hearing was duly called, noticed and held on said application on February 13, 1989. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. That the proposed use is consistent with the Tustin Area General land use designation for commercial uses. 2. That the proposed use is consistent with the Planned Community Commercial District zoning designations subject to approval of a Conditional Use Permit. 3. That a Conditional Use Permit application has been submitted. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E · Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. F. Final development plans shall require the review and approval of the Community Development Department. II. The Planning Commission hereby approves Conditional Use Permit No. 88-30 to authorize the location of a passive fitness parlor/health club at 13721 Newport Avenue, Suite 15 subject to the following conditions attached as Exhibit A. B~Ker Chairman EXHIBIT A USE PERMIT 88-30 CONDITIONS OF APPROVAL RESOLUTION NO. 2564 FEBRUARY 13, 1989 GENERAL (1) 1.1 The location of the proposed use shall conform with the submitted site plan for the project on file with the Community Development Department. 1.2 Unless otherwise specified, conditions contained in this Exhibit shall be complied with prior to issuance of building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional Use Permit approval shall become null and void unless a certificate of occupancy is issued within twelve months from the date of this Exhibit. 1.4 The proposed facility shall be operated as a passive fitness parlor/health club only. The operation shall be limited to seven passive exercise equipment tables, with a maximum of two employees on the site at any time. Aerobic exercise classes and/or a full service or active health club facility shall not be conducted at the site unless an amendment to this Conditional Use Permit is approved by the Planning Commission. 1.5 All employees, members and/or clients using the facility shall sign a statement agreeing to utilize the parking lot along the west property line. A copy of the form to be utilized for this acknowledgement shall be approved by the Department of Community Development. 1.6 The land owner shall notice at least once every six month period beginning March 1, 1989 that employees should park in the parking lot along the westerly property line of the site. A copy of said written notice to tenants shall be provided to the Department of Community Development. 1.7 Sign plans for the project including design, location, size, colors and materials must comply with the Tustin Plaza Master Sign Plan and shall be submitted for review and approval to the Department of Community Development.
