RESOLUTION NO. 2557
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN APPROVING USE PERMIT 88-29 AUTHORIZING THE
CONSTRUCTION OF A 60 SQUARE FOOT DRIVE-UP FEDERAL
EXPRESS KIOSK AT 15732-62 TUSTIN VILLAGE WAY IN AN
EXISTING RETAIL CENTER AT THE NORTHEAST CORNER OF MC
FADDEN STREET AND TUSTIN VILLAGE WAY.
The Planning Commission of the City of Tustin does hereby resolve as
follows'
I. The Planning Commission finds and determines as follows'
A. That a proper application, Use Permit 88-29, has been filed on
behalf of Federal Express Inc. to request authorization to
construct a 60 square foot drive-up kiosk at 15732-62 Tustin
Village Way in an existing retail center located at the
northeast corner of Mc Fadden Street and Tustin Village Way.

That a public hearing was duly called, noticed and held on
January 23, 1989 for said application.
C. That the project has been determined to be Categorically Exempt
(Class 3) pursuant to the provisions of Section 15303 of the
California Environmental Quality Act.
O. That the establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case, be
detrimental to the health, safety, morals, comfort, or general
welfare of the persons residing or working in the neighborhood
of such proposed use, evidenced by the following findings:
1. The use applied for is in conformance with the Tustin
General Plan.
2. The site is located in the C-1 District.
3. The use applied for is a conditionally permitted use in the
C-1 District.
4. The use will not create unusual noise as no amplified
loudspeaker will be used.
5. The project satisfies the City's Parking and Landscaping
Standards.

On-site traffic concerns have been mitigated through the
location and design of the kiosk.
E. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,

nor to the general welfare of the City of Tustin, and should be
granted.
F. That the proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Codes as administered by the Building Official and Fire
Code as administered by the Orange County Fire Marshal.
II. The Planning Commission hereby approves Use Permit 88-29 to authorize
the construction of a 60 square foot drive-up kiosk located at
15732-62 Tustin Village Way in an existing retail center at the
northeast corner of Mc Fadden Street and Tustin Village Way, subject
to the conditions contained within the attached Exhibit A.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission,
held on the 23rd day of January, 1989.

CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans for
the project date stamped January 23, 1989 on file with the Community
Development Department, as herein modified, or as modified by the Director of
Community Development in accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project,
subject to review and approval by the Community Development Department.
{1) 1.3 Use Permit approval shall become null and void unless building permits are
issued within twelve {12) months of the date on this Exhibit.
* 1.4 No outdoor storage or operations shall be permitted.
(1) 1.5 Approval of Use Permit 88-29 is contingent upon the applicant signing and
returning an "Agreement to Conditions Imposed" form as established by the
Di rector of Community Development.
1.6 All current Zoning and Building Code violations within the subject retail
center shall be rectified prior to permit issuance including, but not limited
to: the lack of finaled permits and certificate of occupancy for the dinner
theatre tenant, the unapproved alteration of the center's existing pylon sign,
and the unapproved temporary banners presently displayed by the dinner theatre
and center management.

2.1 At building plan check submittal:

A. Construction plans, structural calculations, and Title 24 energy
calculations. Requirements of the Uniform Building Code, State Handicap
and Energy Requirements shall be complied with as approved by the
Building Official.

Preliminary technical detail and plans for utility installations
including, telephone, gas, and/or electricity. Additionally, a note on
plans shall be included stating that no field changes shall be made
without corrections submitted to and approved by the Building Official.
Undergrounding of all utilities is required.

SITE AND BUILDING CONDITIONS
3.1 All signs shall conform with th: Master Sign Program for the existing retail
center and the Tustin Sign Code. All permits and approvals for signage shall
be processed and issued prior to issuance of a Certificate of Occupancy.
(1) 3.2 All mechanical and electrical fixturesI and equipment shall be adequately and
(4) decoratively screened. The screen shall be considered as an element of the
overall design of the project and shall blend with the architectural design of
buildings. All telephone and electrical boxes shall be indicated on the
building plans and shall be completely screened. Electrical transformers
shall be located toward the interior of the project maintaining a sufficient
distance from frontage of the project.
(1) 3.3 Exterior elevations of the building shall indicate any fixtures of equipment
{4) to be located on the roof of the building, equipment heights and type of
screening. All parapets shall be at least six inches above rooftop equipment
for purposes of screening.
(1) 3.4 All exterior colors to be used shall be subject to review and approval of the
{4) Director of the Community Development Department. All exterior treatments
must be coordinated with regard to color, materials and detailing and noted on
submitted construction plans and elevations shall indicate all colors and
materials to be used.
3.5 The building shall not contain any amplified audio systems audible from
outside the building.
3.6 The applicant shall obtain demolition and any other required permits and
remove the kiosk in order to return the site to its previous condition, should
the applicant's use be discontinued at this location.
LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for
for the kiosk island, to be landscaped consistent with adopted City of Tustin
Landscaping and Irrigation Submittal Requirements. These plans shall reflect
adequate landscaping to enhance the subject kiosk, and consistency with the
retail center's existing landscaping, subject to the approval of the Community
Development Department.
