HomeMy WebLinkAboutPC RES 2552 1 2 3 4 5 6 8 9 10 11 12 13 14 15 17 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2552 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING USE PERMIT 88-28 FOR THE RELOCATION OF A SMALL ANIMAL HOSPITAL FROM 1192 EL CAMINO REAL TO A MODIFIED AUTOMOTIVE REPAIR BUILDING AT 1122 EL CAMINO REAL DUE TO THE PROPOSED WIDENING OF THE I-5 FREEWAY. The Planning Commission of the City of Tustin does hereby resolve as follows' I. The Planning Commission finds and determines as follows' A. A proper application, Use Permit 88-28, has been filed on behalf of Grand Animal Pet Hospital to request authorization to relocate a small animal hospial from 1192 E1 Camino Real to a modified automotive repair building at 1122 E1 Camino Real. B. A public hearing was duly called, noticed and held on said application. Ce Establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: 1. The use proposed is a conditionally permitted use in the CG Commercial General District and conforms to all development standards and regulations of said Zone as they pertain to parking, circulation, structural setbacks, lot coverage, and authorized land use. e The use applied for is in conformance with the Tustin General Plan. 3. The use applied for is an existing use on the adjacent site and does not presently impose any of these negative impacts upon its neighborhood. 4. The use shall be required to conform to pest-control, waste management, noise, odor, and City Animal Control Ordinances. D. Final development plans shall require the review and approval the Community Development Department. The Planning Commission hereby approves Conditional Use Permit No 88-28 to authorize relocation of a small animal hospital from 1192 E Camino Real to a modified building at 1122 E1 Camino Real subject t~ the conditions contained in the attached Exhibit A. Baker Chai rrna n Secretary EXHIBIT A CONDITIO#S OF APPROVAL RESOLUT]O# NO. 2552 1. GENERAL 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped January 9, 1989 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development in accordance with this exhibit. 1.2 Unless otherwise specified, the conditions contained in this exhibit shall be complied with prior to the issuance of any building permit for the project, subject to review and approval by the Community Development Department. 1.3 This Conditional Use Permit approval shall be become null and void unless building permits are issued within 24 months of the date on this exhibit and substantial construction is underway. 1.4 At building plan check, construction plans, structural calculations, and title 24 energy calculations shall be submitted. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be co, lied with as approved by the Building Official. Improvement plans shall include designs to ensure that exterior noise levels will not exceed 60 dba as required by section 4613 of the Tustin City Code. 1.5 At building plan check, provide preliminary technical details and plans for all utility installations including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. 1.6 Applicant shall satisfy all Public Works Department requirements including but not limited to the following: A. The final site plan shall be standardized and reflect all appropriate City standard drawing numbers. The developer shall construct all missing or damaged street improvements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but is not limited to, curbs and gutters, sidewalks, drive apron, and street pavement. 1.7 Applicant shall comply with all requirements of the Orange County Fire Chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department, City of Tustin Public Works Department and compliance with all requirements pertaining to construction. * EXCEPTION Exhibit A Resolution No. 2552 Page two 1.8 Prior to issuance of any building permits, payment shall be made of all required fees including: A. Major thoroughfare and bridge fees to Tustin Public Works Department. B. Sanitary sewer connection fee to Orange County Sanitation District. C. Grading planchecks and permit fees to the Community Development Department. D. All applicable Building plancheck and permit fees to the Community Development Department. E. New development fees to the Community Development Department. F. School facilities fee to the Tustin Unified School District subject to any agreement reached and executed between the District and the developer. 1.9 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of Building permits. * 1.10 Outdoor storage or operations are prohibited at this location. 1.11 Noise and odors from the use shall be contained so as not to be discernable from adjacent properties (maximum 60 dBa at exterior of building). 1.12 Documentation of the following items shall be submitted with the small animal hospital's plan check submittal and yearly business license renewal: A. A County Health Department approved program for maintaining adequate pest control on the premises. B. A County Heal th Department approved program outlining adequate and sanitary waste management for the use. 2. SITE AND BUILDING CONDITIONS 2.1 Note on plans that all exterior colors to be used shall be subject to a review and approval of the Director of the Community Development Department. All exterior treatments must be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations shall indicate all colors and materials to be used. 2.2 Note on plans that a six foot high chain linked fence shall be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. 2.3 All rooftop mechanical or electrical fixtures and equipment shall be screened. All telephone and electrical boxes must be indicated on the building plans and shall be completely screened. Electrical transformers, where provided and wherever possible, shall be located toward the interior of the project maintaining a sufficient distance from frontage of the project. Exhibit A Resolution No. 2552 Page three 2.4 An adequate air conditioning system as determined by the Building Official shall be provided and maintained for as long as the use is in operation. 2.5 Parking shall be maintained at a ratio of four spaces for each on site doctor plus one space for each additional on site employee. The number of employees on site shall not exceed this ratio relative to the provided parking at any time. 2.6 All exterior lighting shall comply with the City's Security Code and shall be installed so that rays do not direct light unto any surrounding properties. Fixture details shall be provided for review and approval by the Director of Community Development. 2.7 A verified plan (by Caltrans) indicating the final site area and dimensions as a result of the Interstate 5 Freeway widening shall be submitted to the Community Development Department prior to submittal for building plan check. The Director of Community Development shall have the authority to authorize minor amendments to the development plan pursuant to Condit(on 1.1 to accommodate Caltrans plans for the site provided said modifications are consistent wi th the Zoning Code. 3. LANDSCAPING, GROUNDS AND HARDSCAPE ELE)IENTS 3.1 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant materials in their actual location. The plan and table must list botantical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control and backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Department of Community Development. 3.2 Final landscaping plans shall address the control of fertilizers, pesticides, and irrigation water runoff. 3.3 Future formal submittals shall substantially conform to the submitted landscaping concept plan on file with the Department of Community Development, as herein and modified or as modified by the Director of Community Development pursuant to the City's Design Review procedures. Exhibit A Resolution No. 2552 Page four 3.4 The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quanity materials during building plan check. Note on landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Department of Community Development. 3.5 The submitted landscaping plans at plan check must reflect the following requirements: a) Turf is unacceptable for grades over 25% a combination of planting materials must be used, ground cover on large areas alone is not acceptable. b) Provide a minimum of one 15 gallon size tree and 5 five gallon shrubs for every 30 feet of property line on the property perimeter. 3.6 All newly planted trees shall be staked according to City standards. 3.7 Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 5 feet on center when intended as screen planning. 3.8 Ground cover shall be planted between 8 to 12 inches on center. 3.9 When i gallon plant sizes are used the spacing may vary according to materials used. 3.10 Up along fences and or walls and equipment areas provide landscaping screening with shrubs, and or vines and trees on plan check drawings. 3.11 All plant materials shall be installed in a healthy vigorous condition typical to the species. 3.12 Landscaping shall be maintained in a neat and healthy condition, this will include but not be limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. 3.13 In irrigation areas the irrigation controller is to be enclosed in a lockable housing. Design irrigation systems to provide sufficient coverage and avoid water overspray on buildings and sidewalks. Note this requirement on plan check drawings. 3.14 Landscape plan shall indicate the replacement of the driveway gutter at the east end of the property by landscaping and subsurface drainage.
