RESOLUTION NO. 2551
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN APPROVING USE PERMIT 88-24 FOR THE
RELOCATION OF A 1560 SQUARE FOOT PET SHOP FROM 1042
WALNUT AVENUE TO THE ADJACENT RETAIL UNIT AT 1032
WALNUT AVENUE IN THE SAME SHOPPING CENTER (PARKLANE
PLAZA) LOCATED AT THE SOUTHEAST CORNER OF NEWPORT
AVENUE AND WALNUT AVENUE.
The .Planning Commission of the City of Tustin does hereby resolve as
follows-
I. The Planning Commission finds and determines as follows'
A. That a proper application, Use Permit 88-24, has been filed on
behalf of Mr. and Mrs. Robert Chaney (Two's Pets) to request
authorization to relocate an existing 1560 square foot pet shop
from 1042 Walnut Avenue to the adjacent retail unit at 1032
Walnut Avenue in the same shopping center (Parklane Plaza)
located at the southeast corner of Newport Avenue and Walnut
Avenue.
B. That a public hearing was duly called, noticed and held on
January 9, 1989 for said application.
C. That the project is Categorically Exempt from the requirements
of the California Environmental Quality Act (Class 1).
D. That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case, be
detrimental to the health, safety, morals, comfort, or general
welfare of the persons residing or working in the neighborhood
of such proposed use, evidenced by the following findings:
1. The use applied for is in conformance with the Tustin
General Plan.
2. The site is located in the Commercial General (CG)
District.
3. The use applied for is a conditionally permitted use in the
Commercial General (CG) District.
4. The use applied for is an existing use on the site.
5. The use applied for is located within an existing,
approved, commercial development.
6. The use will be required to conform to pest control, waste
management, noise and City Animal Control Ordinances.
E. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property

and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should be
granted.
F. That the proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Codes as administered by the Building Official and Fire
Code as administered by the Orange County Fire Marshal.
The Planning Commission hereby approves Use Permit 88-24 to authorize
the relocation of an existing 1560 square foot pet shop from 1042
Walnut Avenue to the adjacent retail unit located at 1032 Walnut
Avenue in the same shopping center (Parklane Plaza) and the
installation of tenant improvements for the purposes of operating
said pet shop {Two's Pets), subject to the conditions contained
within the attached Exhibit A.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission,
held on the 9th day of January, 1989.

GENERAL
1.1 The proposed project shall substantially conform with the submitted plans for
the project date stamped January 9, 1989 on file with the Community
Development Department, as herein modified, or as modified by the Director of
Community Development in accordance with this Exhibit.
1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project,
subject to review and approval by the Community Development Department.
1.3 Use Permit approval shall become null and void unless building permits are
issued within twelve {12) months of the date on this Exhibit.
1.4 A valid City business license and County Animal Facility license shall be
maintained at all times during the course of operations as a pet shop.
1.5 Documentation of the following items shall be submitted with the pet shop's
yearly business license renewal:
A. County Animal Facility License.
B. A County Health Department approved program for maintaining adequate pest
control on the premises.
C. A County Heal th Department approved program outlining adequate and
sanitary waste management for the use.
1.6 No use generated noise or odors shall be discernable from adjacent properties.
1.7 No outdoor storage or operations shall be permitted.
1.B The use shall conform to all animal ordinances adopted by the City of Tustin.
1.9 Approval of Use Permit 88-24 is contingent upon the applicant signing and
returning an "Agreement to Conditions Imposed" form as established by the
Director of Community Development.
PLAN SUBMITTAL
2.1 At building plan check submittal:
A. Construction plans, structural calculations, and Title 24 energy
calculations. Requirements of the Uniform Building Code, State Handicap
and Energy Requirements shall be complied with as approved by the
Building Official. Improvement plans shall include sound attenuating
designs to ensure a maximum 60 dBa noise level at the exterior of the
store.

B. Preliminary technical detail and plans for utility installations
including cable TV, telephone, gas, water and electricity. Additionally,
a note on plans shall be included stating that no field changes shall be
made without corrections submitted to and approved by the Building
Official.
C. Provide initial County Health Department approved programs for pest
control and waste management as described in Condition 1.5.
SITE AND BUILDING CONDITIONS
3.1 All signs shall conform with the Master Sign Program for Parkland Plaza Retail
Center and the Tustin Sign Code. All permits and approvals for signage shall
be processed and issued prior to issuance of a Certificate of Occupancy.
3.2 All mechanical and electrical fixtures and equipment shall be adequately and
decoratively screened. The screen shall be considered as an element of the
overall design of the project and shall blend with the architectural design of
buildings. All telephone and electrical boxes shall be indicated on the
building plans and shall be completely screened. Electrical transformers
shall be located toward the interior of the project maintaining a sufficient
distance from frontage of the project.
3.3 Exterior elevations of the building{s) shall indicate any fixtures of
equipment to be located on the roof of the building, equipment heights and
type of screening. All parapets shall be at least six inches above rooftop
equipment for purposes of screening.
