HomeMy WebLinkAboutPC RES 2527 1 2 3 4 5 6 8 9 10 12 13 15 17 19 20 21 23 24 27 28 RESOLUTION NO. 2527 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING A TEMPORARY USE PERMIT ALLOWING THE STORAGE OF FIREWOOD, VEHICLES AND SUPPORT EQUIPMENT FOR B & J TREE SERVICE AS WELL AS THE SALE OF FIREWOOD FOR A PERIOD OF TIME NOT TO EXCEED SIX (6) MONTHS. The Planning Commission of the City of Tustin does hereby resolve as fol 1 ows' I. The Planning Commission finds and determines' A. That a proper application has been filed by Mr. Bobby Gilbert on behalf of B & J Tree Service requesting approval of a Temporary Use Permit to allow the storage of firewood, vehicles and support equipment as well as the sale of firewood for a period of time not to exceed six (6) months on the property located at 1062 E1 Camino Real. B. That a hearing was duly held on August 22, 1988 for said application. C. That the proposed temporary use is Categorically Exempt (Class 4) pursuant to Section 15304 of the California Environmental Quality Act. D. That establishment, maintenance, and operation of the proposed temporary use will not, under the circumstances of this case, be detrimental or injurious to the property, health, safety, morals, comfort, or general welfare of the persons residing or working in the vicinity of said proposed use, evidenced by the fol 1 owl ng fi ndi rigs: 1. That the proposed temporary use is similar in nature to Christmas tree sales lots which are a temporary use permitted in the C-1 (Commercial Retail) Zone. 2. That the subject property is physically able to accommodate the proposed temporary use. 3. That E1 Camino Real is capable of handling anticipated traffic to the subject site, and access to the site is available through two {2) existing, 33 foot wide driveway curb-cuts. 4. That all potential, adverse impacts associated with the proposed temporary use will be mitigated by the conditions contained herein. 2 5 6 ~0 ~3 ~5 Resolution No. 2527 Page two II. The Planning Commission hereby approves a Temporary Use Permit to allo~, the storage of firewood, vehicles and support equipment as well as the sale of firewood for B & J Tree Service, on the property located at 1062 E1 Camino Real, subject to the following conditions: A. This Temporary Use Permit shall expire six {6) months from the effective date of this approval, or the date Certificates of Occupancy are issued for the LA Land Company project, whichever occurs first. The applicants shall file for a full Use Permit if they wish to extend said temporary use beyond the six (6) months; however, under no circumstances shall an extension allow continuation of said temporary use beyond the date of issuance of Certificates of Occupancy for the LA Land Company project. Co The applicant shall install a six (6) foot high cyclone (chain link) fence around the perimeter of the subject property, except along the southerly property line. De Firewood shall not be stacked above the height of the fencing, and shall comply with the requirements of the Fire Marshal for stacking of combustible material. E. Gravel shall be installed at each driveway with a minimum depth of three (3) inches, extending a minimum of 15 feet onto the site. F. All vehicles and support equipment shall be stored at the rear of the subject property, along the midpoint of the rear property line. Go The applicant shall post a $2,000 bond to ensure clean-up of any and all mud and debris tracked onto E1 Camino Real by said vehicles and equipment and/or customer vehicles. I. Prior to installation of any signing, plans shall be submitted for review and approval by the City. 1 3 4 G 8 9 10 11 13 Resolution No. 2527 Page three J. Hours of firewood sales shall be limited to 8 a.m. to 6 p.m., seven (7) days a week. mm Approval of this Temporary Use Permit is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. L. The applicant shall post "Entrance" and "Exit" signs at the site to coordinate traffic movement. The applicant shall prepare and present a written weed control program (including dates and times) to staff prior to occupancy of the site. N.
