HomeMy WebLinkAboutPC RES 25252 3 4 5 6 7 8 9 10 ' 11 12 13 14 15 16 17 19 21 23 24 26 27 RESOLUTION NO. 2525 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING USE PERMIT 88-1~ ALLOWING INSTALLATION OF TENANT IMPROVEMENTS AT 13812 NEWPORT AVENUE, SUITE 105, FOR THE PURPOSES OF OPERATING A DRY CLEANING STORE WITH ON-SITE CLEANING. The Planning Commission of the City of Tustin does hereby resolve as fol 1 ows: I. The Planning Commission finds and determines that: A. That a proper application, Use Permit 88-18, has been filed by Mr. John Kelleher on behalf of Colco, Ltd. to install tenant improvements at 13812 Newport Avenue, Suite 105 for the purposes of operating a dry cleaning store with on-site cleaning. B. That a public hearing was duly called, noticed and held on August 22, 1988 for said application. C. A Negative Declaration has been prepared and is hereby certified for the project pursuant to the provisions of the California Environmental Quality Act. D. That establishment, maintenance, and operation of the use applied for will not, und6r the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The use applied for is in conformance with the Tustin General Plan. 2. The site is located in the Commercial General (CG) District. 3. The use applied for is a conditionally permitted use in the Commercial General (CG) District. 4. The use applied for is similar to uses existing in the Commercial General (CG) District. 5. The use applied for is located within an existing, approved commercial development. e The Use Permit provides the ability to avoid or mitigate any potential impacts of the proposed project through the imposition of appropriate conditions. 5 6 8 9 1(! 11 12 13 14 15 17 19 20 21 22 23 24 25 26 27 28 Resolution No. 2525 Page two Ee That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. F. That the proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City En gi neer. II. The Planning Commission hereby approves Use Permit 88-18 to allow the installation of tenant improvements at 13812 Newport Avenue, Suite 105, for the purposes of operating a dry cleaning store with on-site cleaning, subject to the following conditions: A. Applicant shall comply wi th all requirements of the Orange County Fire Marshal prior to issuance of building permits. B. Applicant shall comply with all requirements of the South Coast Air Quality Management District prior to issuance of building permits. C. All tenant improvements shall conform to all applicable Building, Fire, State, and Federal Codes and Regulations. Detailed electrical, plumbing and mechanical plans shall be submitted for plan check and permits. D. All signs shall conform with the Master Sign Program for 13812 Newport Avenue and the Tustin Sign Code. All permits for signage shall be processed and issued prior to issuance of a Certificate of Occupancy. E. Approval of Use Permit 88-18 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development.
