RESOLUTION NO. 2507
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, APPROVING VARIANCE 88-06 FOR A
RESTAURANT EXPANSION IN AN EXISTING SHOPPING
CENTER, RESULTING IN AN OVERALL PARKING DEFICIT
OF 56 SPACES.
The Planning Commission of the City of Tustln does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
A. That a proper application, Variance No. 88-06, was filed by the
Golden China Restaurant requesting approval of a restaurant
expansion which will result in an overall deficit of 56 parking
spaces in the Parkland Shopping Center, located at 1046 Walnut
Avenue, Tustin.
B. A public hearing was duly called, noticed and held on said
application on June 13, 1988.

Pursuant to Section 9292 of the Tustin Municipal Code, the
Planning Commission makes the following findings, approving
Variance 88-06:
1. That there are unusual or exceptional circumstances
applicable to the subject property which do not necessarily
apply to other shopping centers in the same zoning
district; in that the joint or shared use of parking spaces
at the subject site during peak hours results in
approximately the same number of vacant, unused parking
spaces as the deficit (56) under which the center would
operate with the approval of this Variance,the Parkland
Center is parked at a higher overall ratio than other mixed
use centers in the City, and the CG zone requires more
parking for restaurants than do other commercial zones in
the City.
2. That the requested Variance would not convey a substantial
property right to the applicant or owner of the shopping
center, which right is enjoyed by other businesses or
property owners in similar circumstances in the same zone;
in that several other shopping centers in the City enjoy
lower overall parking ratios as well as lower restaurant
parking requirements than the subject shopping center.
3. That the granting of this Variance will not be detrimental
to the value of adjacent and surrounding properties; in
that existing on-site parking is expected to accommodate
normal parking demands at peak hours.

4. That the granting of this Variance will not be
contrary to the City's General Plan.
D. That pursuant to Section 15301 of the California Environmental
Quality Act, the subject variance is considered Categorically
Exempt (Class 1).
II. The Planning Commission hereby approves Variance 88-06 subject to the
following conditions'
1. That the "Temporary Parking" signs painted on the walls opposite
the parking spaces at the rear of the buildings be removed, and
these spaces be designated for employee parking only. The owner
of the center shall enforce the use of these spaces by
employees.
2. The hours of operation for the Golden China Restaurant shall
remain as they presently exist, following completion of the
expansion. Any proposed changes shall require prior approval by
the Community Development Director.

All relocation of any existing signs shall require permits from
the Building and Safety Division prior to work being performed.
Any new signs shall require approval of the Planning Division in
addition to building permits.

Should parking problems become apparent, the City reseves the
right to require the Golden China Restaurant to implement valet
parking service during critical hours.
PASSED AND ADOPTED at a regular~meeting of the Tustin Planning Commission,
held on the 13th day of June, 1988.
