HomeMy WebLinkAboutPC RES 2501 1 2 3 4 5 6 l 8 9 10 11 12 13 14 15 16 17 18 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2501 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING USE PERMIT 87-29, AUTHORIZING THE INSTALLATION OF ONE UNDERGROUND TANK TO CONTAIN XYLENE SOLVENT AND ONE ABOVE-GROUND TANK IN A 1986 SQUARE FOOT CONTAINMENT BUILDING TO CONTAIN WATER SOLUBLE ACRYLIC RESIN AT 1123 WANER AVENUE The Planning Commission of the City of Tustln does hereby resolve as fol lows: I. The Planning Commission finds and determines as follows' A. That a proper application, (Use Permit No. 87-29) has been filed on behalf of Steelcase, Inc. to authorize the installation of one underground storage tank to contain xylene solvent and one above ground water soluble acrylic resin tank to be in a 1986 square for containment building at 1123 Warner Avenue. B. That a public hearing was duly called, noticed and held on said appl i cati on. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. That the use applied for is consistent with the land use element of the Tustin Area General Plan as it pertains to industrial uses and with the City Zoning Code. 2. That the use applied for is consistent with the existing zoning regulations as they pertain to installation of storage tanks which contain hazardous materials. 3. That measures to buffer the subject use from adjacent areas have been considered and are incorporated in the plans. 4. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fi re Marshal and street improvement requirements as administered by the City Engineer. F. That a Negative Declaration in conformance with the California Environmental Quality Act has been prepared and hereby is approved. II. The Planning Commission hereby approves Conditional Use Permit No. 87-29 to authorize the installation of one underground storage tank approximately 8000 gallons in size to contain xylene solvent and one above-ground water soluble acrylic resin tank in a 1986 square foot containment building, at 1123 Warner Avenue, subject to compliance with conditions in Exhibit A. PASSED AND ADOPTED at a regular meeting of the Planning Commission of the City of Tustin held on the 23rd day of May, 1988. Chairman Penni Foley ~ Secretary Resolution 2501 EXHIBIT A MAY 23, lg88 CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT 87-29 GENERAL {1) 1.1 The proposed project shall substantially conform with the submitted site plan for the project date stamped May 16, 1988 on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this exhibit shall be complied with prior to the issuance of a building permit for the project, subject to review and approval by the Community Development Department. 1.3 Use permit approval shall become null and void unless building permits are issued within one year of the date on this exhibit. 1.4 The proposed containment building shall be used for tank storage only. 1.5 Unless otherwise specified, conditions contained in this resolution shall be complied with prior to issuance of a building permit for the project, subject to review and approval by tile Orange County Fire Department and the Community Development Department. PLAN SUBMITTAL 2.1 At building plan check, submit three sets of construction level plans as fol lows: (3) A. Construction plans and structural calculations for structures, buildings and tank installation shall be submitted. All plans and calculations shall have wet signature of a licensed engineer. Requirements of the Uniform Building Code, Uniform Fire Code, National Electrical Code, South Coast Air Quality Management District and Orange County Health Care Agency shall be met. B. Provide preliminary technical detail and plans for all utility installations. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Community Development Department. C. The applicant shall comply with all requirements of the Orange County Fire Marshall, including required fire flow, installation where required of fire suppression systems subject to approval as to location by the Fire Department, and compliance with all requirements pertaining to construction. NOISE (1) 3.1 All construction operations including engine warm up shall be subject to '(2) the provisions of the City of Tustin Noise Ordinance and shall take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday unless the Building Official determines that said activity will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. FEES (1) 5.1 Prior to issuance of any building permits, payment shall be made of all (6) required fees including: A. Major thoroughfare and bridge fees to Tustin Public Works Department. B. Sanitary sewer connection fee to Orange County Sanitation District. C. All applicable Building plan check and permit fees to the Community Development Department. D. New development fees to the Community Development Department. E. School facilities fee to the Tustin Unified School District subject to any agreement reached and executed between the District and Steelcase. Exhibit A Resolution No. 2501 Page three SITE AND BUILDING CONDITIONS (1) 5.1 The exterior texture and color of the proposed tank containment building {4) shall be compatible with the adjacent paint mix room. Provide exact details for all proposed exterior texture and color on the proposed containment building construction plans and elevations subject to approval of the Director of Community Development. (1) 5.2 All rooftop mechanical or electrical fixtures and equipment shall be (4) screened from view and incorporated into overall design of the proposed containment buildings. All electrical boxes must be indicated on the building plans and shall be completely screened. (1) 5.3 All piping shall be internal and not visible on building elevations. (4) (1) 5.4 Note on plans that any new utilities serving site to be underground. Show all above ground locations for meters, transformers, manifolds and details for screening.
