CITY OF TUSTIN, CALIFORNIA, ESTABLISHING
3 THE MASTER TREE PLAN AND LIST OF APPROVED
PARKWAY TREES.

5i'~, The City Council of the City of Tustin, California, does
6 ~ hereby resolve as follows:
7 ~ 1. Exhibit A attached hereto designating street trees
for major streets is hereby adopted.

I; 2. The attached List of Approved Parkway Trees is hereby
9I~ adopted.

l0 3. Trees numbered 1 through 19 on the List of Approved
ji Parkway Trees may be planted on streets where a street tree has
11I not been designated on the Master Tree Plan, provided the park-
way in which it is to be placed has the specified minimum width
12 between sidewalk and curbing.
13 A. Planting:
14' a. All planting of parkway trees shall be in accord-
' ance with the Tustin City Code and appropriate
15: city resolutions, and shall be to the specifica-
tions established by the Maintenance Superintendent
10~' as approved by the City Engineer.

(1) Minimum Size: 3/4" Caliper 3" above stump
and 5' in height.
(2) Quality: Good quality, healthy stock, not
root bound, and from a state-inspected nursery.
(3) Shape: Single trunk (except for specialty
trees) and well-shaped.
c. Treewells
Treewells shall be 4' x 4' if sidewalk permits but
in no event shall be smaller than 3' x 3' unless
approved by the Maintenance Superintendent. Tree-
wells shall be located at the curb or at the back
edge of the sidewalk as approved by the City
Engineer after consultation with the Maintenance
Superintendent.
d. Homeowners who have not previously had a parkway
tree may obtain a parkway tree of their choice from
the approved list by paying the City $20.00 for a
15-gallon tree, or the City's actual cost for a
larger tree. The City will plant the tree without
further charge.
e. Homeowners who have lost a parkway tree may obtain
a replacement at no charge upon request to the
City.

f. Subdividers or developers shall contract with the
City for planting of their required parkway trees
and pay the City's cost for the tree, all planting
costs, labor, overhead, and one year's maintenance.
If approved by the City Engineer, they may install
the trees directly in accordance with the City's
specifications, subject to City inspections, and
pay the one-year maintenance fee. The charge for
the standard 15-gallon tree, planting, and main-
tenance shall be $35.00 per tree, or $45.00 per
tree if planted in a treewell. The charge for
one-year maintenance alone for a standard 15-
gallon tree shall be $5.00.
B. Removal.
a. The City will remove and replace as the budget
permits:
(1) Dead trees (unless killed through fault of
a known party).
(2) Dying, decayed or hazardous trees.
(3) Trees diseased or infested beyond reclamation.
(4) Trees directly in way of new sidewalks, curbs
or driveway approaches.
(5) Trees having undesirable growth characteris-
tics and which are causing sidewalk or curb
damage.
b. The City may, at its discretion, remove (or permit
removal by the property owner) and replace any
tree having undesirable growth characteristics
although not presently causing sidewalk or curb
damage.
c. A property owner may retain a tree in the category
of "a (5)" or "b" above, unless said tree is
creating a real and immediate hazard, by entering
into an agreement with the City accepting all
liability caused by the tree and all costs of
root pruning, repairing sidewalk and curbing, and
other directly related City costs of retaining
said tree. No agreement shall be required until
and unless the City is actually prepared to remove
the tree in question.
d. The City may remove unauthorized or nonapproved
trees not of a definite problem species upon the
request of a property owner. Removal and replace-
ment with an authorized species will normally be
conditioned upon the property owner's purchase of
a new tree in accordance with paragraph ld above.
The replacement tree shall be of a 15 gallon or
greater size depending upon the size of tree being
removed and the adjacent street trees.
e. Any person who has killed, damaged or destroyed
any street tree shall be held accountable for the
actual cost of removal and replacement, or treat-
ment, including labor and overhead expense.

4. Variations or modifications may be granted to a
developer or subdivider to permit variation of the distance
between trees, to change the type of trees, or to permit the
abandonment of any tree upon approval by the Development Preview
Commission with the concurrence of the City Engineer and Mainte-
nance Superintendent, in order to accommodate special circumstances
or to provide different but comparable planting.
5. Modifications of tree specifications or tree wells
may be made by the City Engineer with the concurrence of the
Maintenance Superintendent in order to meet special situations.
j 6. The Maintenance Superintendent is authorized to
change the type of tree and distance between trees when physical
conditions, such as soil conditions, parkway width, utilities,
drive approaches, or overhead obstructions justify such modifica-
tions.
7. Revisions to the Master Tree Plan and Approved Park-
; way Tree List shall be recommended from time to time to the City
Council by the Development Preview Commission after consulting
with the City Engineer and Maintenance Superintendent.

certify that the whole number of the members of the City
