HomeMy WebLinkAboutPC RES 2438 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19' 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2438 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, AUTHORIZING A SIX (6) MONTH EXTENSION OF USE PERMIT 86-30 FOR CONSTRUCTION OF A 1104 SQUARE FOOT MINI-MARKET AND GASOLINE SALES STATION AT 14082 RED HILL AVENUE. The Planning Commission of the City of Tustin does hereby resolve as - fol 1 ows' I. The Planning Commission finds and determines as follows: A. That a proper request for extension for Use Permit No.86-30 has been filed on behalf of the Exxon Company U.S.A. requesting authorization for a six {6) month extension to al low for construction and operation of .a 1104 square foot mini-market and gasoline sales station at 14082 Red Hill Avenue. B, That a pubic hearing was duly called, noticed and held on said application. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental · to the heal th, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, as evidenced by the following findings: 1. Section 9293-b of the Tustin Municipal Code authorizes the Planning Commission to grant time limit extensions on previously approved Use Permits. 2. The project is in relative conformance with the previously approved Use Permit. 3. The use applied for is in conformance with the Tustin General Plan and is a conditionally permitted use in the C-1 Retail Commerical Zoning District. D. That the extension requested will allow for the establishment, maintenance, and operation of a use which will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. 1 2 3 4 5 6 8 9 10 11 12 13 14 ~5 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2438 page two E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fi re Marshal and street improvement requirements as admi ni stered by the City Engineer and - requirements of the County of Orange Environmental Management Agency. F. This project is categorically exempt from the requirements of the California Environmental Quality Act. G. Final development plans shall require the review and approval of the Community Development Department. II. The Planning Commission hereby approves a 6 {six) month extension of Conditional Use Permit No. 86-30 to authorize a 1104 square foot mini-market and gasoline sales station at 14082 Red Hill Avenue subject to the following conditions: A. All conditions of approval contained in Resolution No. 2366 which authorizes Use Permit 86-30 shall apply to this extension. B. The use applied for shall be constructed and in operation prior to April 13, 1987 unless an .extension of this time limit is approved by the Planning Commission.
