HomeMy WebLinkAboutPC RES 2434 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 2~ 25 26 27 28 RESOLUTION NO. 2434 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 87-19 FOR DEVELOPMENT OF A 266 UNIT APARTMENT COMPLEX ON LOT 14 OF TRACT 12763 The Planning Commission of the City of Tustin does hereby resolve as follows- I. The Planning Commission finds and determines as follows: A. That a proper application, Use Permit No. 87-19 has been filed on behalf of Irvine Pacific Company requesting authorization to develop a 266 unit apartment complex on Lot 14 of Tract 12763. That a public hearing was duly called, noticed and held on said appl i cation. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the heal th, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. That the proposed project is in conformance with East Tustin Specific Plan and the Tustin Area General Plan as they relate to multiple family housing land use. 2. That the proposed project is in conformance with conditions and requirements of Tract 12763. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. F~ It has been determined that final environmental impact report 85-2 certified on March 17, 1987 in conjunction with the East Tustin Specific Plan adequately addresses environmental considerations associated with the proposed project and no additional environmental documentation will be prepared. G. The Planning Commission hereby approves Conditional Use Permit No. 87-19 to authorize development of a 266 unit apartment complex on Lot 14 of Tract 12763 subject to the following conditions: Ae That all conditions of approval contained in Resolutions 2433- (Design Review 87-32) shall be complied with as a condition of Use Permit 87-19. Said conditions are incorporated herein by reference. PASSED AND ADOPTED at a regula~meeting of the Tustin Planning Commission, held on the 28th day of September, 1987.
