STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ACCEPT IMPROVEMENTS FOR THE COLUMBUS TUSTIN GYMNASIUM PHOTOVOLTAIC (SOLAR) IMPROVEMENT, CIP NO. 10065/FEDERAL AND AUTHORIZE THE CITY ENGINEER TO FILE THE NOTICE OF COMPLETION SUMMARY Construction of the Columbus Tustin Gymnasium Photovoltaic (Solar) Improvement, CIP No. 10065/federal, has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council: 1. Adopt Resolution No. 11-83 accepting the construction of the Columbus Tustin Gymnasium Photovoltaic (Solar) Improvement, CIP No. 10065/federal; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the County Recorder's Office. FISCAL IMPACT Funding for this project came entirely from the Energy Efficiency and Conservation Block Grant (EECBG) Program issued through The American Recovery and Reinvestment Act (ARRA) of 2009. The final construction cost for the Columbus Tustin Gymnasium Photovoltaic (Solar) Improvement is $549,300. BACKGROUND/DISCUSSION The American Recovery and Reinvestment Act (ARRA) of 2009, appropriated $2.7 billion in funding for the Department of Energy (DOE) to issue/award formula-based grants to states, U.S. territories, units of local government, and Indian tribes under the Energy Efficiency and Conservation Block Grant (EECBG) Program. The purpose of the EECBG Program is to assist eligible entities in creating and implementing strategies to reduce fossil fuel emissions, reduce total energy use and improve energy efficiency. Pursuant to federal grant funding eligibility, the City Council approved Resolution No 10-14 adopting the City's Energy Efficiency and Conservation Strategy (EEGs) and identifying photovoltaic installation at Columbus Tustin Gymnasium as its top priority project for full utilization of EECBG grant funding. Projected annual energy savings from this installation is estimated at $23,800. The City also applied to the California Public Utilities Commission for California Solar Initiative (CSI) funding and received approval. The CSI Program provides upfront incentives for solar Notice of Completion for CT Gym Solar Project November 15, 2011 Page 2 systems installed on existing residential homes, as well as existing and new commercial, industrial, government, non-profit, and agricultural properties within the electrical utility service territories. The City's potential incentive through CSI is estimated at $161,000. Stack, P.E. of Public Works/City Engineer Attachment 1: Resolution No. 11-83 S \City Council Items\2011 Council Items\NOC CT Gym Sotar.docx Attachment 1 RESOLUTION NO. 11-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR CONSTRUCTION OF COLUMBUS TUSTIN GYMNASIUM PHOTOVOLTAIC (SOLAR) IMPROVEMENT, CIP NO. 10065/FEDERAL WHEREAS, Stellar Solar, having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Columbus Tustin Gymnasium Photovoltaic (Solar) Improvement, CIP No. 10065/Federal BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
