CAL. ro ORDINANCE NO. 29 AN ORDINANCE AMENDING SECTION FOUR OF ORDINANCE NUMBER 4 OF THE CITY OF TUSTIN, ENTITLED "AN ORDINANCE. PROVIDING FOR LICENSING AND REGULATING THE CARRYING ON OF CERTAIN PROFESSIONS, TRADES, CALLINGS AND OCCUPATIONS IN THE CITY OF TUSTIN", AS AMENDED BY ORDINANCE NO. 14 OF THE CITY OF TUSTIN. The Board of ,Trustees and City Council of the City of Tustin do ordain as follows: SECTION 1: Section 4 of Ordinance Number 4., of the City of Tustin entitled, "An Ordinance providing for licensing and regulating the,carrying on of certain professions, trades, callings and occupations in the City of Tustin", as amended by Ordinance Number 14 of the City of Tustin, is hereby amended to read as follows: 1. All business and occupational licenses shall be paid in advance, in the legal currency of the United States, at the office of the City Clerk of the City of Tustin. 2. The Licenses required to be paid by the provisions of this Ordinance, to -wit, Ordinance Number 4; shall be and become due and payable on and from the first day of January of each year, except as otherwise specifically provided; a separate license must be obtained and must be paid by each branch establishment or separate place of.business in which the trade, calling, profession or occupation is carried on. The monthly license, provided'to be paid in Ordinance 2 Number 4, shall be due and payable to the City on the First day 3 of each calendar month, in advance, from all persons who have 4 for the previous month been licensed to carry on the same trade, 5 calling,profession or occupation, and from all p p , persona who have 6 not been licensed for the previous month for the same trade, 7 calling, profession or occupation, the said monthly license shall 8 be due and payable in full, ,and must be procured at the time such 9 person or persons shall engage in said trade, calling, profession 10 or 'occupation, and shall remain in full force and effect during 11 the remainder of such current month only, and such license must be 12 procured b such p y. persons before commencing to carry on such 13 trade, calling, profession or occupation. 14 4. The quarterly license in said Ordinance Number 4 15 provided, shall be due and payable to the City on the First day 16 of Januar April Jul and October of each y, , y year, and all such 17 licenses shall expire with the last day of March, June, September 18 and December of each year, but the first quarterly license issued 19 to an person as herein y provided, shall be issued for unexpired 20 one-third or two-thirds of the current quarter, whichever may be 21 most exact; provided, however,"that any person, firm or corpora - 22 tion desiring to do so may pay for, and procure all four quarterly 23 licenses at the time the first quarterly license becomes due and' 24 payable under the provisions of said Ordinance Number 4. 25 5. The weekly licenses, in Ordinance Number 4 provided, 26 shall be due and payable to the City Clerk on Monday of each 27 week, in advance. 28 6. The daily licenses, in Ordinance Number.4 provided,. 29' shall be due and payable to the City Clerk daily, in advance, 30 prior to the commencement of business for the day. 31 7. The semi-annual licenses, provided in said Ordinance 32 Number 4, shall be due and payable to the City at the times MORRIS CAIN ATTORNKY-AT.LAw SANTA ANA, CAL. -2- 8 in which latter event one-half the amount of said semi-annual 9 license shall be charged. 1.0 8. All licenses specified and provided for in said 11 Ordinance Number 4 are hereby designated as a.nnual licenses, unlese 12 in said Ordinance otherwise specifically provided; the annual 13licenses, provided for in said Ordinance Number'4, shall be due 14 and payable to the City Clerk at the time specified in said 15 Ordinance Number 4, respectively, or when not so specified on the 16 First day of January of each year;,provided, however, that in the 17 case of annual licenses any person, corporation or .association of 18 persons may, at their option, elect to pay said annual license 19 semi-annually, in which event one-half thereof shall be due and 20 payable. on the First da of.Janua.r of each y y y year, and one-half 21 thereof on the First da of Jul of each y y year, and in which event 22 the Cit Clerk shall issue a license for one-half City year or for one 23 year, as the case may be, expiring at the end of the period for 24 which payment is actually made; but the first annual license 25 issued to any person, as in said Ordinance provided, shall be 26 issued for the unexpired period of such year, or one-half year, 27 as such person may elect, except as in said Ordinance otherwise 28 specifically provided,. and payment for such license shall be 29 required only for such portion of such year as shall remain, 30 computed on a quarterly basis, full payment being required for 31 each unexpired quarter year, or portion thereof remaining. CAL. 1 specified herein, respectively, or when not so specified, on the 2 First day of January and July of each year, but the first semi - 3 annual license issued to any person, as in said Ordinance pro - 4 vided, shall be issued for the unexpired period of such one-half 5 year, except as in said Ordinance otherwise specifically provided, 6 and the full semi-annual license shall be charged unless there 7I shall be remaining less than three months of such license period, 8 in which latter event one-half the amount of said semi-annual 9 license shall be charged. 1.0 8. No greater or less amount of money shall be charged 4 or received for any license than is provided for in said Ordinance 5 Number 4, and no license shall be sold or issued for any period 6 of time other than is provided in said Ordinance Number 4. 7 SECTION 2: If any section, sub -section, sentence, 8 clause or phrase of this Ordinance is for any reason held to be 9 invalid or unconstitutional, such decision shall not affect the 1.0 validity of the remaining portion of the Ordinance. The Council 11 of the City of Tustin hereby declares that it would have passed 12 this Ordinance, and each section, sub -section, sentence, clause 13 or phrase thereof, irrespective of the fact that any one or more 14 of the sections, sub -sections, sentences, clauses or phrases be 15 declared invalid or unconstitutional. 16 17 SECTION 3: All Ordinances, or parts of Ordinances, 18 to the extent -that the same conflict herewith, are to that 19 extent hereby repealed. 20 SECTION 4: The City Clerk shall certify to the passage 21 of this Ordinance, and cause this Ordinance to be published once 22 in "The Tustin News", a weekly newspaper published and circulated 23 in the ,City of Tustin, -California, and thirty days thereafter it 24 shall,take effect and be 3n force.. 25 26 27 28 I, J.
