Adrian Morton 78 Consuelo Tustin Spoke in support of the proposed skateboard park at Frontier Park. Richard Edgar 345 W. First St. #29 Tustin Announced he had been selected as Califomia/Orange County Senior Assemblyman. PUBLIC HEARING - None Approved Approved Approved CONSENT CALENDAR (ITEMS 1 THROUGH 9 ) It was moved by Bone, seconded by Kawashima, to approve the Consent Calendar as recommended by staff. Motion carried 5-0. , APPROVAL OF MINUTES - JUNE 17, 2002 REGULAR MEETING Recommendation: Approve the City Council Minutes of June 17, 2002. , APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,197,346.60 and ratify Payroll in the amount of $431,656.20. 3. APPROVAL OF AMENDMENT AND RESTATEMENT OF NPDES IMPLEMENTATION AGREEMENT NO. D02-048 Recommendation: Approve the Amendment and Restatement of NPDES Implementation Agreement No. D02-048 with the participating Orange County cities, the County of Orange, and the Orange County Flood Control District, and authorize execution of the agreement by the Minutes - City Council July 1, 2002 - Page 2 Adopted Resolution No. 02-62 Approved Approved Approved Ratified Adopted Resolution No. 02-63 , , Mayor and City Clerk on behalf of the City as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 02-62- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE ANNUAL STREET/ALLEY REPAIR PROGRAM (402-6245) AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 02-62 approving the plans and specifications for the Annual Street/Alley Repair Program and authorizing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. CLAIM OF CONNIE KRAMER, CLAIM NO. 02-07 Recommendation: Deny the claim and direct the City Clerk to send notice thereof to Claimant and the Claimant's attorneys as recommended by the City Attomey. . CLAIM OF KAREN A. KELLY, CLAIM NO. 02-12 Recommendation: Deny the claim and direct the City Clerk to send notice thereof to Claimant and the Claimant's attomeys as recommended by the City Attorney. , CLAIM OF TROY BLAND, CLAIM NO. 02-10 Recommendation: Deny the claim and direct the City Clerk to send notice thereof to the Claimant and the Claimant's attorneys as recommended by the City Attomey. . PLANNING COMMISSION ACTION AGENDA- JUNE 24, 2002 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of June 24, 2002. o RESOLUTION NO. 02-63- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE EXECUTION AND DELIVERY OF A SIXTH SUPPLEMENTAL FISCAL AGENT AGREEMENT AND OTHER MA-I-I'ERS RELATED THERETO Recommendation: Adopt Resolution No. 02-63 approving the execution and delivery of a Sixth Supplemental Fiscal Agent Agreement and other matters related thereto as recommended by the Finance Director. REGULAR BUSINESS (ITEMS 10 THROUGH 12) Minutes - City Council July 1,2002 - Page 3 Staff to advertise for applicants, set interviews and appointments for August 5, 2002; and termed-out commissioners must sit out one year before reapplying for a position. Approved $2,500 donation to Miss Tustin Pageant and approved the fee waiver for Veterans Day Parade. Approved None 10. PLANNING COMMISSIONER RESIGNATION It was moved by Wodey, seconded by Kawashima, to direct staff to advertise for Planning Commission applicants, set interviews and appointments for August 5, 2002, and establish a policy for termed-out commissioners to sit out one year before reapplying for a vacant position. Motion carried 5-0. 11. COMMUNITY SUPPORT REQUEST Councilmember Bone stated he opposed using taxpayer funds for the Miss Tustin Pageant event. It was moved by Kawashima, seconded by Worley, to donate $2,500 to the Miss Tustin Pageant. Motion carried 4-1, Bone opposed The following member of the audience spoke in support of the Veterans Day Parade fee waiver: Ronald Melendaz, 1300 S. Grand Ave, Santa Ana It was moved by Thomas, seconded by Kawashima, to approve the fee waiver for the Veterans Day Parade. Motion carried 5-0. Councilmember Bone clarified he opposed using taxpayer money to support events that benefited only a limited group of individuals; however, he was in favor of supporting events which the entire community could benefit and participate in, such as the Veterans Day Parade. 12. PLANNING AREA 20, TUSTIN LEGACY - SELECTION OF DEVELOPER TO ENTER INTO AN EXCLUSIVE NEGOTIATION AGREEMENT It was moved by Kawashima, seconded by Doyle, to select John Laing Homes and direct staff to prepare an Exclusive Agreement to Negotiate with the developer for the disposition and development of Planning Area 20 in the Tustin Legacy project. Motion carried 5-0. SECOND PUBLIC INPUT Minutes - City Council July 1,2002 - Page 4 OTHER BUSINESS AWARD OF DISTINCTION Councilmember Doyle congratulated Tustin Police Officer Doug Howard for receiving the California Peace Officers Association Award of Distinction. LEGISLATION ON SPORT UTILITY VEHICLES (SUVs) Councilmember Doyle commented on legislation that would increase fees for SUVs and pickup trucks. JOHN WAYNE AIRPORT Councilmember Bone noted that the Board of Supervisors had supported extending the restrictions on John Wayne Airport. TUSTIN'S INCORPORATION Councilmember Bone remarked on a recent newspaper article regarding Tustin's incorporation 75 years ago. MAKE A WISH FOUNDATION Councilmember Kawashima stated that July was "Make a Wish" month and noted the Make a Wish Foundation had its grand opening in Tustin. TUSTIN SPORTS PARK Mayor Pro Tem Worley stated the tennis net at the Sports Park needed repair. El CAMINO REAL CONSTRUCTION PROJECT Mayor Pro Tem Worley asked when the El Camino Real construction schedule would be completed. Tim Serlet, Public Works Director, responded construction would be completed in mid to late September. VOLLEYBALL TOURNAMENT Mayor Pro Tem Worley stated she had attended a volleyball tournament in Davis. CENTENNIAL PARK Mayor Pro Tem Worley noted Council had voted to refurbish the Centennial Park bathrooms by next year and approved field lighting at Utt. Minutes - City Council July 1, 2002 - Page 5 MAIL BOXES Mayor Thomas complained about the raise in postal rates and the removal of mail boxes in Tustin Ranch. SPECIAL YOUTH CONCERT Mayor Thomas announced a Peppertree Park concert, consisting of a 48-piece orchestra from Israel, would be held on July 2, 2002, at 6:30 p.m. 75TM ANNIVERSARY ART EXHIBIT Mayor Thomas stated a 75th anniversary art exhibit and reception would be held at the Tustin Area Senior Center on July 11,2002, at 7:00 p.m. CONCERTS IN THE PARK Mayor Thomas announced the next Concert in the Park would be held on July 3, 2002, 6:00 p.m., at Peppertree Park. PLEDGE OF ALLEGIANCE Councilmember Doyle remarked on the Ninth Circuit Court and the pledge of allegiance order. Mayor Thomas stated the pledge of allegiance would continue to be recited at Council meetings. 4TM OF JULY Councilmember Doyle wished everyone a safe 4th of July and invited the community to Tustin High School for the fireworks show. Councilmember Kawashima invited everyone to attend the Tustin Meadows 4~h of July parade and the fireworks show at Tustin High School. Mayor Pro Tem Worley invited the community to the fireworks show at Tustin High School, noted the music theme was surf, and announced the show was free. Mayor Thomas noted 4"~ of July events in Tustin Meadows, Centennial Park, and at Tustin High School. ED PANKEY Mayor Pro Tem Wodey requested adjourning the meeting in memory of Ed Pankey who recently passed away. Mayor Thomas and Councilmember Doyle spoke on Mr. Pankey's life and passing. COMMITTEE REPORTS - None Minutes - City Council July 1,2002 - Page 6 CLOSED SESSION - None ADJOURNMENT- Mayor Thomas adjourned the meeting at 9:03 p.m. in memory Ed Pankey. The next regular meeting of the City Council was scheduled for Monday, July 15, 2002, at 7:00 p.m. in the Council Chamber at 300 Centennial Way. JEFFERY M.
