HomeMy WebLinkAboutPC RES 2379 1 2 3 4 5 6 8 9 10 13 14 15 1t3 17 18 19 20 21 22 23 25 2¢ 27 28 RESOLUTION NO. 2379 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING VARIANCE 86-7 AUTHORIZING THE DEVELOPMENT OF THREE (3) APARTMENTS AT 1421 SAN JUAN WHILE VARYING WITH THE MINIMUM LOT WIDTH REQUIREMENTS. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows' A. That a proper application, Variance No. 86-7, was filed by A. J. Coco on behalf of San Juan Partners requesting authorization to vary with the minimum lot-width requirements to allow three (3) apartments at 1421 San Juan. B. That a public hearing was duly called, noticed and held on said application. C. That because of special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following findings' · 1. The use is in conformance with the land use element of the Tustin Area General Plan and the Zoning Code. 2e The City prezoned the property to the R-3 2700 classification knowing that not all properties in the area met code requirements. De That the granti'ng of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. E. That a negative declaration is hereby approved to comply wi th the requirements of the California Environmental Quality Act. F~ That the granting of the variance as herein provided will not be contrary to the intent of the Zoning Ordinance or the pulic safety, health and welfare, and said variance should be granted. G. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Codes as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2379 Page two He Final development plans shall require the review and approval of the Community Development Director. II. The Planning Commission grants a variance as applie.,, for, to authorize the development of three (3) apartments while varying with the minimum lot-width requirements. A. A complete landscape and irrigation plan shall be submitted prior to issuance of building permits. Said plan shall include location and description of the following' . LANDSCAPE a. Plant materials b. Provision of recreation amenities · IRRIGATION a. point of connection; b. back flow prevention device(s); c. location and types of valves; d. location and sizes of piping; e. sprinkler head types, locations and manufacturer model; f. automatic sprinkler controller location and specifications. B · A separate street improvement plan will be "equired and should show all existing and proposed public improvements adjacent to this development. All missing or damaged public improvements will require construction or replacement. Construction items shall be referenced to the applicable City standard drawing numbers and shall include but not be limited to the following: 1. Curb and gutter 2. Sidewalk 3. Street trees 4. Street light(s) 5. Domestic water 6. Sanitary sewer service(s) C. Payment of Orange County Sanitation District No. 7 sewer connection fees will be required at the time a Building Permit is issued. De Payment of East Orange County Water District fees will be required prior to i?suing the Building Permit. E. Payment of the required fees for the Major Thoroughfare and Bridge Fee Program will be required at the time a Building Permit is issued. F. H · The property owner will be required to annex this parcel to the Tustin 1972 Lighting and Landscape District. The City of Tustin Engineering Division will require fr~.? the property owner a letter stating that he will not protest said annexation. The annexation of this parcel will take place in July, 1987. The property owner will be required to pay installation charge for any required street light(s) to the Edison Company and pay to the City of Tustin the advanced energy charge to cover the operating/maintenance costs for a period of 18 months. Any excess advanced energy charge collected will be refunded to the property owner once the annexation is finalized. I · Continuous 6" concrete curbs shall be provided along landscape planters adjacent to parking spaces and drive aisles. All utilities serving the subject property shall be required to be underground. Payment of parkland dedication fees prior to permit issuance ($600.0O). Lo The exterior of the existing structure shall be upgraded to match the colors and materials of new structures. M · A lighting plan shall be reviewed and approved prior to issuance of permits.
