STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 11-89 TO APPROVE THE SUBMITTAL OF THE 2011 REGIONAL CAPACITY PROGRAM PROJECT APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY SUMMARY City Council adoption of Resolution No. 11-89 will approve submittal of the City's project application for Renewed Measure M funds (Measure M2) under the Comprehensive Transportation Funding Program (CTFP}, 2011 Call far Projects for the Regional Capacity Program. The Orange County Transportation Authority (OCTA) requires City Council approval as part of the application process. RECOMMENDATION It is recommended that the City Council adapt Resolution No. 11-89 approving the submittal of a project application to the Orange County Transportation Authority (OCTA} for funding under the Renewed Measure M Comprehensive Transportation Funding Program 2011 Call for Projects for the Regional Capacity Program. FISCAL IMPACT If the proposed application is approved by OCTA, the City's funding obligations for this project in the Seven-Year Capital Improvement Program will be reduced by approximately $11.4 million. City matching funds for this project are included in the Capital Improvement Program. DISCUSSION Renewed Measure M {Measure M2) is a 30-year, multi-billion dollar program extension of the original Measure M (approved in 1990) with a new slate of planned projects and programs. Measure M2 is comprised of a number of components such as: Project O {Regional Capacity Program}, Project P (Regional Signal Synchronization Program), Project O {Local Fair Share Program), and the Transit Program (Projects S, T, V, and W}. The Comprehensive Transportation Funding Program {CTFP) represents a collection of competitive grant programs offered to local agencies. OCTA is responsible for planning and coordination of county regional transportation components, and administering a variety of funding sources including Renewed Measure M, state/federal gas taxes and Transportation Development Act (TDA) revenues. On March 22, 2010, the Board of Directors of the OCTA approved the guidelines for local agencies to apply for funding under the Renewed Measure {M2) and authorized their staff to issue a call far projects under the Regional Capacity Program of the CTFP. The amended guidelines were subsequently approved by the Board on September 26, 2011. Submittal of Project Application to OCTA December 6, 2011 Page 2 The 2011 Call for Projects is the second annual call for Project O -the Regional Capacity Program (RCP) under Measure M2's CTFP and covers fiscal years 2012/13 through 2014115. This call will provide approximately $35 million far street and road improvements across Orange County. Monies will be provided for the following three RCP funding programs during this call for projects: Arterial Capacity Enhancements (ACE), Intersection Capacity Enhancements (ICE), and Freeway Arterial/Streets Transitions (FAST). Based upon the components of the RCP, City staff has prepared a project application as follows: CTFP Funding Fiscal Year Estimated Proposed CTFP Grant Project Program (Fund Phase * Total Project Amount requested) Cost Re uested Tustin Ranch Road Extension from Regional Capacity ** FY 12/13 (C) $25.0 million $11.4 million Walnut Avenue to Warner Avenue Pro ram -ACE *Fund Phase Requested: E -Engineering R -Right of Way C -Construction **ACE -Arterial Capacity Enhancements The total amount requested in RCP funds is approximately $11.4 million. The following is a brief description of the project: Tustin Ranch Road Extension from Walnut Avenue to Warner Avenue: This project consists of constructing a new roadway facility/extension of Tustin Ranch Road from Walnut Avenue to Warner Avenue, including a grade separation at Edinger Avenue and the OCTA/SCRRA Railroad. Resolution No. 11-89 designates the project application to be submitted by the City for the 2011 Call for Projects -Regional Capacity Program under the OCTA CTFP. The Renewed Measure M funding eligibility requires City Council approval of the application for funding under this program. The application for this project was submitted to the OCTA by its deadline of December 2, 2011. Adopting the resolution after that date is acceptable to OCTA staff and serves to complete the initial administrative process for receipt of the applications. Douglas S. Stack, P.E. ~ir~ctor of Public WorkslCity Engineer Attachment: Resolution 11-89 S:1City Council Items~2011 Council ItemsICTFP Regional Capacity Program Grant Applications 2011.docx RESOLUTION NO. 11-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE SUBMITTAL OF AN IMPROVEMENT PROJECT APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER THE RENEWED MEASURE M COMPREHENSIVE TRANSPORTATION FUNDING PROGRAM, 2011 CALL FOR PROJECTS FOR THE REGIONAL CAPACITY PROGRAM WHEREAS, the City of Tustin desires to implement the transportation improvements listed in Exhibit A; and WHEREAS, the City of Tustin has been declared by the Orange County Transportation Authority to meet the eligibility requirements to receive Measure M "Fair Share" funds; and WHEREAS, the City's Circulation Element is consistent with the County of Orange Master Plan of Arterial Highways; and WHEREAS, the City of Tustin will provide matching funds for each project as required by the Orange County Comprehensive Transportation Program Procedures Manual; and WHEREAS, the Orange County Transportation Authority intends to allocate funds for transportation improvement projects within the incorporated cities and the County; and WHEREAS, the City of Tustin will not use Renewed Measure M funds to supplant Developer Fees or other commitments; and WHEREAS, the City of Tustin will use Arterial Highway Rehabilitation Funding as a supplement to the existing pavement management program; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that it hereby requests the Orange County Transportation Authority allocate funds in the amounts specified in the City's applications to said City from the Comprehensive Transportation Funding Programs. Said funds shall be matched by funds from said City as required and shall be used as supplemental funding to aid the City in the improvement of the streets included in Exhibit A.
