RESOLUTION NO. 2355
A RESOLUTION OF THE PLANNING COMMISSION OF THE-
CITY OF TUSTIN, APPROVING A VARIANCE OF THE SIGN
CODE REQUIREMENTS TO ALLOW A 98.6 SQUAREFOOT
SIGN AT 520 EAST FIRST STREET
·
The Planning Commission of the City of Tustin does hereby resolve as
follows®
I. The Planning Commission finds and determines as follows'
A. That a proper application, (Variance No. 86-6) was filed by
Mr. Ted Fessler on behalf of Larwtn Square Lt~., requesting
authorization to vary with the requirements of the Tustin Sign
Code to allow a 98.6 square foot sign at 520 E. First Street.
B. That a public hearing was duly called, noticed and held on said
app 1 i ca ti on.
C. That because of special circumstances applicable to the subject
property, relative to size, shape, topography, location or
surroundings, a strict application of the Sign Code is
found to deprive subject property of privileges enjoyed by other
properties in the vicinity and under identical zone
classification, evidenced by the following findings: .
1. The use is in conformance with the Tustin Area General
Plan.
2. That because' of exceptional circumstances applicable to the
subject property, the strict application of the sign code
is found to deprive subject property of privileges enjoyed
by other properties in the vicinity and under similar
circumstances.
3. The sign location and user are set back over 300 feet from
Newport Avenue and the required setback is only 15 feet.

Due to the configuration of the shopping center and the
existing landscaping, the visability of the unit at 520 E.
First Street is severely impared.
5. The sign user is considered a major tenant of the Larwtn
Square shopping center and leases a minimum of 10,000
square feet of store area.
Other bust nesses such as the Wherehouse, Drug
Emporium, Royal Stationers, Marshall's, Miller's Outpost,
and Schick Movers, enjoy pri vi ledges of signs which, as
approved by variances, are larger than the Sign Code
allows.

That the granting of a variance as herein provided will not
constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and district
in which the subject property is situated.
That this project is categorically exempt from the requirements
of the California Environmental Quality Act.(Class II)

That the granting of the variance as herein provided will not be
contrary to the intent of the Sign Code or the public safety,
health and welfare, and said variance should be granted.
Proposed development shall be in accordance with the development
policies adopted by the City Council; Uniform Building Codes as
administered by the Building Official; Fire Codes as
administered by the Orange County Fire Marshal; and street
improvement requirements as administered by the City Engineer.

Final development plans shall require the review and approval ot~
the Community Development Director.
II.
The Planning Commission grants a variance as applied for, to
authorize the installation of a 98.6 square foot sign at 520 E. First
Street, subject to the following conditions:

The tenant using this 98.6 square foot sign shall remain as a
major tenant of 10,000 square feet or more.
Be
This sign shall conform to all provisions of the Tusttn Sign
Code except the requirement for size.
