HomeMy WebLinkAboutPC RES 23401 [1 1 2 3 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23~ 24 25' 26' 27 28 RESOLUTION NO. 2340 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT CERTAIN FLOOD CONTROL IMPROVEMENTS ARE IN CONFORMITY WITH THE GENERAL PLAN OF THE CITY OF TUSTIN WHEREAS, the existing trestle bridge at the Atchison, Topeka and Santa Fe Railway crossing of the FO6 Peters Canyon Channel causes a constriction in the flow of said FO6 Channel; and WHEREAS, said trestle bridge has in the past been nearly overtopped and has caused upstream flooding by said FO6 Channel; and WHEREAS; the Orange County Flood Control District proposes to remove said trestle bridge and to construct a stngle track box girder bridge across said FO6 Channel where indicated on Exhibit "A" attached hereto; and WHEREAS; the Government Code of the State of California Section 65402, provides in part that a local agency shall not acquire real property nor dispose of any real property, nor construct a public building or structure in any county or city, until the location, purpose and extent of such activity has been reported upon as to conformity with the adopted General Plan applicable thereto. NOW, THEREFOEE, BE IT RESOLVED that the Planning Commission of the City of Tustin does hereby fi nd that the proposed flood control improvements are in conformity with the adopted General Plan of the City of Tustin.
