HomeMy WebLinkAboutPC RES 2336 1 4 5 6 7 8 9 10 11 12 13 15 16 17 18 19 ~0 ~.1 ~5 27 28 RESOLUTION NO. 2336 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, AMENDING USE PERMIT 76-25 AUTHORIZING THE ENCLOSURE OF THE GARDEN SHOP AREA ADJACENT TO THE STRUCTURE AT 500 EAST 1st STREET AND AMENDING USE PERMIT 77-23 AUTHORIZING THE CONVERSION OF THE EXISTING KEY SHOP IN LARWIN SQUARE SHOPPING CENTER TO AN AUTOMATED BANK TELLER. The Planning Commission of the City of Tusttn does hereby resolve as follows- I. The Planning Commission finds and determines as follows' A. That a proper application, (Amendment to Use Permits No. 76-25 and 77-23) has been filed on behalf of Larwin Square, Ltd, to authorize the enclosure of the garden shop (5,115 square feet) adjacent to 500 E. 1st, and to authorize the conversion of an existing key shop to an automated bank teller. B. That a public hearing was duly called, noticed and held on said application. C. That the proposed amendments to Use Permits 76-25 and 77-23 were approved by Planning Commission Resolution No. 2211. O. That the constru6tion authorized by Resolution No. 2211 did not commence within one year from date of approval and therefore said approval expired. E. That the project applicant has re-submitted a proposal again requesting amendments to Use Permits 76-25 and 77-23 authorizing the enclosure of a garden shop area (5,115 square feet) adjacent to 500 E. First Street, and authorizing the conversion of an existing key shop into an automated bank teller. F. That a public hearing was duly called, noticed, and held on said re-submi ttal. G. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the heal th, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. That the project is in conformance with the criteria and intent of the City of Tustin Zoning Ordinance and the Tustin Area General Plan in that it is a retail/commercial use in the Central Commercial (C-2) Zoning District. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20~ 21 22 23 24 25 26 :/7 28 Resolution No. 2336 Page two 2. That the area to be enclosed was calculated as usable retail space for the purposes of parking demand at the time Use Permit 76-25 was approved. Therefore, the center is in compliance with parking requirements for the site. . That the Planning Commission hereby determines that the subject site has been expanded to capacity using parking ratio established by Use Permit 76-25. Any future additions to the center will require renovation of the parking lot design. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shal 1 be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the California Environmental Qual i ty Act. G. Final development plans shall require the review and approval of the Community Development Department. II. The Planning Commission hereby approves amendments to Use Permits No. 76-25 and 77-23 to authorize the enclosure of the garden shop area {5,115 square feet) adjacent to 500 East 1st and to authorize the conversion of the existing key shop in Larwin Square to an automated bank teller subject to the following conditions: A. That prior to issuance of any building permits for proposed modifications, the parking lot must be stripped to reflect the site plan approved wi th the original amendment approval by Resolution No. 2211. B. That the materials and architectural style of the enclosure and the coverted key shop match the existing structures in the center. C. That stnce the Commission has determined that the center is butlt to capacity ustng the parking rat.to established by Use Permit 76-25, any future additions to the center wt11 require a complete renovation of the parking layout.
