RESOLUTION NO. 2332
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN RECOMMENDING TO THE CITY COUNCIL
DISPOSITION OF SURPLUS ROAD RIGHT-OF-WAY ON
MYFORD ROAD AT DOW AVENUE
The Planning Commission of the City of Tustln does hereby resolve as follows-
1. The Planning Commission finds and determines as follows'
A. That a proper application was filed by the Irvine .Industrial
Research and Development Company for the purpose of determining
the needs, if any, of public right-of-way known as Myford Road as
described by Exhibit "A" and as delineated on Exhibit "B" attached
hereto and incorporated herein by this reference as set forth
herein in full.
B. That the subject property should be declared excess to the City's
needs and disposed of for private development for the following
reasons-
1. The road alignment and configuration of Myford Road has been
constructed to its ultimate alignment which vacates subject
area.
2. The property is not sbttable nor adequate for other publt
purposes, such as parks or recreational needs.
3. There is no present known use of the property as street
ri ght-of-way.
C. That pursuant to Section 8330 of the Streets and Highways Code for
the State of California, it is possible to reserve public interest
in easements for sewer, storm drains, and utility purposes.
Do That the Commission recommends the vacation of the easement for
street purposes to the adjoining property owner without fee.
E. Subject project ts categorically exempt from the requirements of
the California Environmental Quality Act.
F. That the vacation of the subject street right-of-way will be in
conformance with the City of Tustin General Plan.

2. The Planning Commission, pursuant to Sections 37350 and 65402 of the
Government code, hereby recommends to the City Council the declaration
of the subject parcel as excess to the need~ of the City and 1ts
disposition to the adjoining property owner w{th the reservation of
easements to conduct, maintain, operate, replace, remove and renew
those facilities necessary' for storm drain, sewers, and public
ut111 tles.
