STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 12-01 TO APPROVE LOT LINE ADJUSTMENT NO. 2011-01 ~"1 f 3 N/A SUMMARY A lot line adjustment has been requested by the property owner to develop a driveway on a portion of a vacant lot at 1702 Nisson Road to provide private access in fee to the existing Willows Apartments at 1712 Nisson Road. The proposed lot line adjustment application has been submitted by Doris Sue Maxwell, property owner of 1702 Nisson Road, and Paul Dunlap, Attorney- in-Fact for the property owner of 1712 Nisson Road. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 12-01 approving Lot Line Adjustment No. 2011-01. FISCAL IMPACT There is no fiscal impact associated with this item. DISCUSSION The California Subdivision Map Act allows a local agency to approve lot line adjustments. Currently, the Willows Apartments at 1712 Nisson Road shares a driveway with the Blue Buoy Swim School at 1702 Nisson Road. The approval of the Lot Line Adjustment will allow the applicants to remove the existing ingress and egress easement over a portion of the Blue Buoy Swim School property and enable the applicants to design and construct a private access dedicated to the Willows Apartment residences. The Lot Line Adjustment Application has been reviewed by the Community Development Department and the Public Works Department. The proposed adjustment has been determined to be in compliance with all zoning requirements of the City, the provisions of the California Subdivision Map Act, and the California Environmental Quality Act. Directorof Public Works/City Engineer Attachment 1: Resolution No. 12-01 Attachment 2: Location Map Attachment 3: Application for Lot Line Adjustment No. 2011-01 S:\City Council Items\2012 Council ItemsWdopt Resolution No. 12-01 Approving Lot Line Adjustment No 2011-01.docx Attachment 1 RESOLUTION NO. 12-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 2011-01 WHEREAS, Section 66412(d) of the California Subdivision Map Act makes provisions for a local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where no additional parcels are created; and WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 2011-01 and has made findings that the real property, described in Exhibit "A" and shown on Exhibit "B", comply with the provisions of the California Subdivision Map Act and applicable City of Tustin Ordinances and Regulations including the requirements for building sites; and WHEREAS, the City Council of the City of Tustin has made the following findings: 1. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412(d) of the California Subdivision Map Act; 2. That the requirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the City of Tustin General Plan; and 4. That the resultant parcels will meet the requirements of the City of Tustin Zoning Code. NOW, THEREFORE, BE IT RESOLVED that proposed Lot Line Adjustment No. 2011- 01, as shown on Exhibits "A" and "B", is hereby approved and that the resulting parcels be considered building sites, subject to the following: 1. The applicant shall prepare and record a new deed reflecting Lot Line Adjustment No. 2011-01, as shown on Exhibits "A" and "B"; and 2. This Resolution shall become null and void if the deed reflecting Lot Line Adjustment No. 2011-01 is not recorded with the Recorder's Office of Orange County, California within six (6) months of the date this Resolution is adopted.
