The Planning Commission finds and determines as follows' Ae That a proper application, (Use Permit No.85-16) has been filed by Lincoln Property Company requesting authorization to construct a 160 unit apartment complex on the vacant property at the Southerly terminus of Newport Avenue. That a public hearing was duly called, noticed and held on said app 1 i ca ti on. Co That the establishment, maintenance, and operation of the use applied for will be injurious lOP detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin, and should not be granted based upon the following findings: lo That the precise alignment of the proposed Newport Avenue extension has not been determined and exact land dedication requirements are at this time unknown. That denial of this project is without prejudice and the applicant may re-submit an application for a project subsequent to an engineering study formalizing the precise alignment of the Newport extension. De Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. The Planning Commission hereby denies, without prejudice, Conditional Use Permit No. 85-16.
