RESOLUTION NO. 2246
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA,
GRANTING A CONDITIONAL USE PERMIT ON THE APPLICATION OF MR. DICK MEYERS ON
BEHALF OF SHELL OIL CORPORATION, TO CONVERT A LUBE BAY TO A CAR WASH AND A
SALES AREA TO A MINI MARKET AND CASHIERS BOOTH, AND CONSTRUCTION OF AN
ATTACHED 6'x12' STORAGE AREA.
The Planning Com;lsston of the City of Tusttn does hereby resolve as
follows: _
I. The Planning Co;mission finds and determines as follows:
A. That a proper application (Use Permit No. 85-10) has been filed by
Mr. Dick Meyers on behalf of Shell Oil Corporatio.n to authorize
the conversion and expansion of a lube bay to a car wash and a
sales area to a cashier's booth and mini market and construction
of a 6'x12' storage area.
B. That a public hearing was duly called, noticed and held on 'Said
application.
C. That establishment, maintenance, 'and operation of the use applied
for will not, under the circumstances of this case, be detrimental
to the health, safety, morals, comfort, or general welfare of the
persons residing 1 or working in the neighborhood of such proposed
use, evidenced by the following findings:
1. The use is in 'conformance with the Tustin Area General Plan and
with use and application proce~lures of the Zoning Code
(Sectt on g232b).
D. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject p. roperty, nor
to the general welfare of the City of Tusttn as evidenced by
compliance with the City's Zoning and Development standards.
E. Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Orange County Fire Marshal and street improvement
requirements as administered by the City Engi neet.

Ii. The Planning Commission hereby approves Use Permit #85-13 to
authorize the conv. erston and expansion of the southerly lube bay to a
476 square foot, car wash, the conversion and expansion of the
existing sales area to a 375 square foot mini market and cashier's
booth, and the construction of an attached 72 square foot storage
area at 13891 Red Hill Avenue subject to te following conditions:
A. Compliance with Engineering Department requirements for the
following:
1. Any mtsstng or damaged public improvements shall be installed
or rep1 a ced.
2. Annexation to Street Ltghttng Dtstrtct No. 6.
3. Installation of marbeltte street lights with underground
conduit as required.
4. Provide an irrevocable offer of dedication of ten (10) feet
along Red Hill Avenue and an appropriate corner cut off to
accommodate curb return radius.
5. Construction of a handicap ramp at the curb return per City
Standard Orawing Number 124 A & B.
B. Final developement plans shall require the review and approval of
the Communtty Oevelopment Department.
C. Prior to the issuance of building permits, the subject property
shall submit a sign plan for review and approval, and shall remove
all t11egal or unapproved signs so Installed.

Prtor to the installation of the mini market and car wash, any
slgns or face changes and their appropriate p, lans as authorized by
Stgn Ordinance No. 684, shall be approved and permitted prtor to
their installation.
E,.Approva.1 of Use .Permit 85-13 is contingent upon the applicant
signing and returning an "Agreement to Conditions Imposed" form as
established by the director of Community Development.
