A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, GRANTING A VARIANCE (85-3) TO VARY FROM THE R-3 DISTRICT ZONING REGULATIONS AT 510 SOUTH "C" STREET The Planntng Commission of the City of Tusttn does hereby resolve as fo11 ows': .: I. The Planning Commission finds and determines as follows: A. That a proper application (Variance No. 85-3) was filed by James Needham on behalf of Basic Shelter, Inc., requesting authorization to vary from the requirements of the lot width and garage size in the R-3 District in order to construct four apartments at 510 S. "C" Street. B. That a public hearing was duly called, noticed and held on said appl i ca ti on. C. That because of special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive subject property of privileges enjoyed by other properti es i n the vi ct ni ty and under i denti cal zone classification, evidenced by the following findings: '1. The use is in conformance with. the land use element of the Tusttn Area General Plan. 2. That the property was subdivided prior to the incorporation of the city of Tustin. D. That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. E. That this project is categorically exempt from the requirements of the California Environmental Quality Act.(Class II.) Fe That the granting of the variance as herein provided will not be contrary to the intent of the Zoning Ordinance or the public safety, health and welfare, and said variance should be granted. G. II. The Planning Commission grants a variance as applied for, to authorize the development of four apartments at 510 S. Any missing or damaged public Improve'merits will be required to be constructed and/or replaced. Any work within the public right-of-way should be shown on the final site and/or gradi?g plan and noted with appropriate city standard drawing numbers. · A grading plan will be required and should indicate all proposed key elevations within the development as well as existing elevation on properties adjacent to and northerly, westerly and southerly of said site. The following fees will be required at the time a building permit is issued' a. Orange County Sanitation District No. 7 fees in the amount of $250. O0 per dwel 1 ing unit. b. East Orange County Water District fees in the amount of $500.00 per dwelling unit. Street lights may be required. Two copies of a site plan should be submitted to Archi, Berry at Southern California Edison Co. for the street light determination. A trash enclosure must be provided.
