HomeMy WebLinkAboutPC RES 2173 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 25 26 27 28 RESOLUTION NO. 2173 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA APPROVING USE PERMIT NO. 84-14 AUTHORIZING THE REMODEL AND EXPANSION OF AN EXISTING COMMERCIAL SHOPPING CENTER AT THE NORTHEAST CORNER OF 17th STREET AND CARROLL WAY TO VARY FROM THE OFFSITE PARKING STANDARDS OF THE ZONING ORDINANCE AND THE MAXIMUM SIGN AREA PERMITTED BY THE SIGN ORDINANCE The Planning Commission of the City of Tustin does hereby resolve as follows: Ie The Planning Commission finds and determines as follows: · A. That a proper application for Use Permit 84-14 has been filed on behalf of Watkins Commercial Properties by Barry Watkins requesting authorization to remodel and expand a commercial shopping center located at the northeasterly corner of 17th Street and Carroll Way. B. That included within this application are proposed variances from the City's zoning ordinance for fewer parking spaces than required by code and a proposed variance from the City's sign ordinance to permit a larger freestanding monument sign than permitted by code. C. That a public hearing was duly called, noticed and held on said application. D. That the Planntng Commission hereby makes the following findings: 1. That establishment, maintenance, and/or operation of the use applied for will not be detrimental to the health, safety, or morals of the persons residing or working in the neighborhood of such proposed use, in that: ae The proposed activity is in compliance with the use restrictions and application procedures of the City Code section 9235, Commercial General Zone. e The establishment, maintenance and/or operation of the use applied for will not be detrimental to the comfort and general welfare of persons residing or working in the neighborhood of the proposed use in that the activity is proposed for the correct land use and zoning classification and shall be developed in a manner prescribed by the City's development and zoning provisions. The establishment, maintenance and/or operation of the use applied for will not be injurious or detrimental to property, improvements in the neighborhood, or general 1 3 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 25 27 28 Resolution No. 2173 page 'L~o welfare of the City in that the project will be constructed in conformance with 1979 Uniform Building Code, as adopted by Ordinance No. 835. 4. The filing of a Negative Declaration of Environmental Impact is hereby approved. 5. The proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Code as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal, and street improvement requirements as administered by the City Engi neet. e Final Development plans shall be reviewed and approved by the Community Development Department. De The Planning Commission further finds pursuant to Section 9292 of the Tustin City Code that the variances as applied for, shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated and that because of special circumstances applicable to the subject property, the strict application of the zoning ordinance is found to deprive subject property of privileges enjoyed by others in the vicinity and under identical zone classification. II. The Planning Commission hereby grants Use Permit 84-14 subject to the conditions attached in Exhibit A. PASSED AND ADOPTED at ~ting of the Tustin Planning Commission on 13th day of August, 1984. Recording Secretary Chairperson EXHIBIT "A" CONDITIONS OF APPROVAL USE PERMIT NO. 84-14 1. Development of the subject property shall be in substantial conformance with the site plan and elevations reviewed and approved by the Planning Commission. The final site plan and elevations of all building exteriors shall be submitted for approval by the Community Development Department prior to issuance of any building permits. 2. The monument tenant identification sign on Seventeenth Street and/or Carroll Way shall be reduced to the maximum dimension of seven feet (7') high by fifteen (15') in width. A maximum of three center tenants shall be identified by name only which does not include product brand names. 3. The final landscape and irrigation plans shall be reviewed and approved by the Community Development Department prior to any parking area reconstructi on or 1 andscape modi fi cati on. 4. The enclosed truck delivery dock on the northerly side of Building "B" shall architecturally match the building exterior and be fully enclosed during truck unloading to mitigate adverse noise which may be produced. 5. Use Permit 84-14 shall restrict truck loading and unloading along the northerly side of the shopping center to those hours between 7:00 a.m. and 6:00 p.m., Monday through Saturday. 6. Outdoor storage will not be permitted, except vehicle display, subject to Planning Commission approval. 7. The final design plans for exterior restaurant dining shall Be subject to City staff approval. 8. All permitted businesses, and those conditionally permitted by this Use Permit, shall abide by all provisions of the Tustin City Code, in particular Noise Ordinance regulations. 9. Trash enclosures shall be constructed of masonry material, covered and secured to prohibit unauthorized dumping which presents a nuisance to the surrounding community. 10. Building "A" shall be set back a minimum of ten feet (10') from the Carroll Way ri ght-of-way. 11. A grading plan shall be required for those areas where new structures will be built. 12. All new structures shall be connected to sanitary sewer and domestic water systems. All such connections within the public right-of-way shall be shown on the final grading plans. 13. Payment of Orange County Sanitation District No. 7 sewer connection fees will be required at the time a building permit is issued. PaymentI of East Orange County Water District fees for the new structures, "A", "F" and "G" will be required at the time a building permit is issued. 15. The location of Building "A" would require several of the parking stalls to back into a parking aisle for egress. Parking spaces adjacent to the Carroll Way driveway shall be eliminated or relocated at the direction of the City Engi neet. 16. Parking stalls adjacent to Building "F" back into the main drive entrance from Seventeenth Street. Either the drive entrance shall be relocated or the three parking spaces eliminated. 17. Modification of the driveway on Seventeenth Street and removal of the pylon sign may require work within the public right-of-way. This work shall be shown on the final grading plan and noted with appropriate City standard references. 18. Marbelite street light standards, wi th underground conduit, will be required at certain locations along Carroll way subject to the direction of the City Engineer/Director of Public Works. 19. The project architect shall submit building area calculations complying with Sections 505 and 506 of the Uniform Building Code.
