RESOLUTION NO. 2133
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING USE PERMIT
NO. 83-25 AUTHORIZING A NINE (9) FOOT BLOCK WALL
ON THE PROPRTY LOCATED AT 1331 GARLAND AVENUE
Planning Commission of the City of Tustin does hereby resolve as

The Planning Commission finds and determines as follows-
A. That a proper application, (Use Permit 83-25) has
been filed by O'Dell and Associates on behalf of Mr. &
Mrs. William Heller requesting authorization to retain a
none {9) foot block wall on the property located at 1331
Garland Avenue.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use as
evidenced by the fol lowing fi ndi rigs:
1. that a wall in excess of 6'8" in height is permitted
pursuant to Section 9271(i)(3) of the Tustin City
Code.
2. that the structural integrity of the wall shall be
verified and any necessary corrections shall be made
within 60 days of the date of this resolution.
D. That that establishment, maintenance and operation of
the use applied for will not be injurious or detrimental
to the property and improvements in the neighborhood of
the subject property, nor to the general welfare of the
City of Tustin and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council,
Uniform Building Codes as administered by the Building
Official, Fire Code as administered by the Orange County
Fire Marshal and street i~rovement requirements as
administered by the City Engi neet.
F. That this project is categorically exempt from the
requirements of the California Environmental Quality
Act. (Class 3, Section 15303(e)).

G. Final develop plans shall require the review and approval
of the Community Development Department.
II. The Planning Commission hereby approves Conditional Use
Permit No. 83-25 authorizing the retention of a nine (9)
foot block wall as constructed on the eastern property line
of the property located at 1331 Garland Avenue, subject to
the following conditions:
A. All structural calculations, plans and other required
documents must be submitted to the Building Department
for review and permit issuance. These documents must
demonstrate the structural integrity of the wall
specifically by showing footing size, and the horizontal
and vertical reinforcing steel. Additinally, as
required by the building inspector, the footings
supporting the wall shall be exposed to ensur that they
comply with the requirements of the Uniform Building
Code. These calculations, plans and all other required
documents shall be submitted to the Building Department
within 60 days from the date of approval.
B. That a curb cut and drive apron must be installed to
accommodate vehicle egress and ingress at the point
where a gate has been installed as a part of the wall
along Woodlawn Avenue. Plans for the curb cut and drive
apron must meet all City standards and must be approved
by the City Engineer. Prior to any work within the
public right-of-way, all required permits must be
obtained from the Public Works Department.
PASSED AND ADOPTED at a regular meeting,of the Tustin Planning
Commission held on the 9th day of January, 1984
